TRADUCTIONS EN CONTEXTE

Pursuant to Article 58(4) of Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006 , as from 1 December 2010 Article 57(a), (b) and (c) of Regulation (EC) No 1907/2006 shall refer to the classification criteria laid down respectively in Sections 3.6, 3.5 and 3.7 of Annex I to Regulation (EC) No 1272/2008.
Conformément à l’article 58, paragraphe 4, du règlement (CE) no 1272/2008 du Parlement européen et du Conseil du 16 décembre 2008 relatif à la classification, à l’étiquetage et à l’emballage des substances et des mélanges, modifiant et abrogeant les directives 67/548/CEE et 1999/45/CE et modifiant le règlement (CE) no 1907/2006 , à dater du 1er décembre 2010, les points a), b) et c) de l’article 57 du règlement (CE) no 1907/2006 font référence aux critères de classification énoncés respectivement aux sections 3.6, 3.5 et 3.7 de l’annexe I du règlement (CE) no 1272/2008.

27. Notes that the former Executive Director of the Agency wrote to the Agency on 28 December 2010 outlining the activities which he was intending to take up at the end of his term of office; considers the first decision of 11 January 2011, taken by the Chairman of the Agency Management Board, to authorise the new activities of the former Executive Director of the Agency to be a breach of Union rules relating to conflicts of interest, in particular with regard to Title II, Article 16, of the Staff Regulations of the Officials of the European Communities; recalls that according to Title II, Article 11, and title IV, Article 91, of the Conditions of Employment of Other Servants of the European Communities, this provision applies by analogy to temporary agents and to contract employees; considers the fact that the Management Board adopted limitations on the future activities of the former Executive Director on 17 March 2011 - only after strong public protest - to be clear proof that the Agency did initially not apply the Staff Regulations properly, which in turn raises serious questions about their application of the rules in general; asks the Executive Director to present a detailed report on the implementation of Article 16 of the Staff Regulations within the Agency;
27. observe que l'ancien directeur exécutif de l'Agence a écrit à cette dernière le 28 décembre 2010 pour exposer les activités qu'il avait l'intention d'exercer à la fin de son mandat; estime que la première décision du 11 janvier 2011, prise par le président du conseil d'administration de l'Agence, qui autorisait les nouvelles activités de l'ancien directeur exécutif de l'Agence, constitue une infraction à la réglementation de l'Union relative aux conflits d'intérêts, en particulier au regard du titre II, article 16, du statut des fonctionnaires des Communautés européennes; rappelle que conformément au titre II, article 11, et au titre IV, article 91, du régime applicable aux autres agents des Communautés européennes, cette disposition s'applique par analogie aux agents temporaires et aux agents contractuels; estime que le fait que le conseil d'administration ait adopté, le 17 mars 2011, des restrictions aux futures activités de l'ancien directeur exécutif – uniquement après de vives protestations publiques – démontre à l'évidence qu'à l'origine, l'Agence n'a pas appliqué correctement le statut des fonctionnaires, ce qui, par voie de conséquence, soulève de graves doutes sur la façon dont elle applique la réglementation en général; demande au directeur exécutif de présenter un rapport détaillé sur l'application de l'article 16 du statut des fonctionnaires au sein de l'Agence;
