4. If the administrative inquiry referred to in paragraph 2 does not lead to the removal of the irregularities or if the Commission identifies shortcomings in the control system of a Member State during the inspections referred to in Articles 89, 90 and 91 or in the audit referred to in Article 92, the Commission shall establish an action plan with that Member State.

2. Subject to available funding, and the absence of a suspension of payments in accordance with Article 92, the Commission shall make the interim payment no later than two months after the date on which a application for payment meeting the conditions referred to in Article 86 is registered with the Commission.

(92) The Commission considers that the aid granted to González y Díez S.A. for the years 1998 and 2000 pursuant to Article 5 of Decision 3632/93/ECSC exceeds the costs incurred by the restructuring carried out in 1998 and 2000 in accordance with Article 3 of that Decision, and was consequently not used for the purposes for which it had been authorised by the Commission.

(92) The Commission further notes that the undertaking concerning ex post monitoring given by Germany complies with the obligations laid down in point 6 of the multisectoral framework, in particular as regards the obligation to communicate to the Commission a copy of the decision granting the aid as well as an annual report on the project and the other information and documents to which point 6.4 of the multisectoral framework refers.
(92) La Commission constate en outre que l'engagement pris par l'Allemagne au sujet du contrôle a posteriori remplit les conditions énoncées au chapitre 6 de l'encadrement multisectoriel, et notamment en ce qui concerne l'obligation de transmettre à la Commission un exemplaire de la décision relative à l'octroi de l'aide ainsi qu'un rapport annuel sur le projet et les autres renseignements et documents mentionnés au paragraphe 6.4 de l'encadrement multisectoriel.
