3. Notes with concern from the Court’s report that the effectiveness of the procurement procedures in the year 2013 was affected by some decisions not being based on sufficiently specific selection criteria or realistic price offers, as well as by not being in accordance with the established professional requirements, although the Office improved the preparation, execution and documentation of procurement procedures over the years; acknowledges from the Office that further to the Court’s findings, it has initiated an organisation-wide review of the overall procurement process in 2014, with a view to refining the current internal organisational set-up and the underlying processes; calls on the Office to inform the discharge authority on the outcome of the review and planned improvements to the procurements process;
3. observe avec préoccupation, à la lumière du rapport de la Cour, qu'en 2013, l'efficacité des procédures de marchés publics a été mise à mal par certaines décisions qui ne reposaient ni sur des critères de sélection suffisamment précis ni sur des offres tarifaires réalistes et qui n'étaient pas conformes aux exigences professionnelles en vigueur, même si, au fil des ans, l'Office a fait des progrès en matière d'élaboration, d'exécution et de documentation des procédures de marchés publics; note que, selon l'Office, à la suite des conclusions de la Cour, celui-ci a entamé en 2014 un examen à l’échelle de l’organisation de l’ensemble des procédures de passation de marchés, en vue d’améliorer la structure de l’organisation interne actuelle et les processus sous-jacents; demande à l'Office de communiquer à l'autorité de décharge le bilan de cet examen et les améliorations qu'il compte apporter aux procédures de passation de marchés;

Notes, in that connection, that although Europol has made progress over the years in the area of the preparation, implementation and documentation of procurement procedures, the effectiveness of those procedures still needs to be improved, in that selection criteria are still not sufficiently specific and price offers are still not realistic or consistent with established professional requirements; welcomes Europol’s efforts to set up a central procurement entity with responsibility for ensuring that high standards are maintained at all the main stages in the procurement process; takes the view that this will result in better quality control during tender procedures and ensure that the tenders submitted are robust and meet the requirements laid down; notes the information contained in Europol’s answers concerning the review being conducted of recruitment and procurement procedures as a whole, with the aim of refining the current internal organisational set-up;

The term “Pension Fund of a Governmental Entity, International Organisation or Central Bank” means a fund established by a Governmental Entity, International Organisation or Central Bank to provide retirement, disability, or death benefits to beneficiaries or participants who are current or former employees (or persons designated by such employees), or who are not current or former employees, if the benefits provided to such beneficiaries or participants are in consideration of personal services performed for the Governmental Entity, International Organisation or Central Bank.

Deplores the inadequate protection of IPR in China, and regrets the lack of specific means available to European businesses, and particularly SMEs, to counter IPR infringements effectively; welcomes the Commission’s decision to propose a review of the directive on the enforcement of IPR; calls on the Commission and Member States to defend IPR better in all multilateral organisations where China is a member (the WTO, the World Health Organisation(WHO) and the World Intellectual Property Organisation (WIPO)); wants China to continue to transpose into its national legislation current international law on the protection of IPR and, more specifically, to combat counterfeiting and piracy, and urges the Chinese authorities to ensure enforcement, especially at a regional level; regrets that China has not taken part in the negotiations on the Anti-Counterfeiting Trade Agreement (ACTA); urges the Commission and the Member States to step up customs cooperation in the EU and with third countries, particularly with China, on the seizure of counterfeit goods, and to simplify customs procedures; asks the Commission and the Member States to cooperate more closely with third countries on copyright issues and licensing;
déplore l'insuffisante protection des DPI en Chine et regrette le manque de moyens concrets mis à disposition des entreprises européennes, notamment les PME, pour lutter efficacement contre les infractions aux DPI; salue la décision de la Commission de proposer une révision de la directive sur la mise en œuvre des DPI; appelle la Commission et les États membres à mieux défendre les DPI dans toutes les organisations multilatérales dont la Chine est membre (l'OMC, l'Organisation mondiale de la santé et l'Organisation mondiale de la propriété intellectuelle); souhaite que la Chine continue à transposer dans sa législation nationale le droit international en vigueur en matière de protection des DPI et plus particulièrement la lutte contre la contrefaçon et le piratage, et insiste pour que les autorités chinoises veillent à leur application, particulièrement au niveau régional; regrette que la Chine n'ait pas pris part aux négociations de l'accord commercial anti-contrefaçon (ACTA); appelle la Commission et les États membres à une coopération douanière accrue dans l'Union et avec les pays tiers, notamment avec la Chine, dans la saisie des marchandises contrefaites, et à simplifier les procédures douanières; demande à la Commission et aux États membres de coopérer plus étroitement avec les pays tiers sur les questions de droits d'auteur et l'octroi de licences;

Supports the Commission's efforts to enhance cooperation with third countries and international organisations, including the United Nations, the Council of Europe and the OECD, as well as with standardisation organisations such as the European Committee for Standardisation (CEN), the International Organisation for Standardisation (ISO), the World Wide Web Consortium (W3C) and the Internet Engineering Task Force (IETF); encourages the development of international standards , while ensuring that there is coherence among initiatives for international standards and current revisions in the EU, the OECD and the Council of Europe;

Building on the experience gained so far with the current pilot project on relocation from Malta, the Commission will support an extension of this project in view of the current influx of migrants seeking international protection there, to be implemented in close cooperation with the United Nations High Commissioner for Refugees and the International Organisation for Migration.

The logistical arrangements could be modelled on the resettlement programmes currently operating in certain European countries under the auspices of the Office of the UN High Commissioner for Refugees. Transport could be organised by the International Organisation for Migration (IOM).
