The Criminal Code allows for a citizen's arrest as it stands right now. The amendment to section 494 would address that, but where an individual is caught in the act of committing a crime on a person or property and a citizen immediately detains the subject, therein lies the current state of the Criminal Code which addresses a citizen's arrest.

A private prosecution has been brought against Mr Hans-Peter Martin in the Vienna Regional Criminal Court on 6 June 2007 by Merkur Treuhand Wirtschaftstreuhand- und Steuerberatungs Gesellschaft mit beschränkter Haftung for commercial defamation pursuant to Section 152 of the Austrian Criminal Code on the ground that, both on his website www.hpmartin.net and in APA-OTS press release OTS0189 5 11 0473 NEF0006 in connection with the accusations against him (by the EU anti-fraud authority OLAF) of improper use of the secretarial assistance allowance for staff, he had claimed that it had been established after a comprehensive, detailed investigation that he had in no way improperly used EU monies and that fault had been found only with a formal error on the part of his accounts manager at the time, Mr Christoph Matznetter, a tax adviser now State Secretary for Finance in the Austrian Government, who, according to Mr Martin, had incorrectly charged three staff computers and two telephone bills to the secretarial assistance allowance instead of to the office expenses allowance.

Urges China to reform its criminal law to allow greater freedom of expression to journalists, writers, freelancers, reporters etc., who will report to the world on such an important event as the 2008 Olympic Games; considers that such reform will also make it possible to clarify the scope of certain unclear legal provisions (e.g. Article 105 of China's Criminal Code), and give the world a positive signal that the Seventeenth National Congress of the Chinese Communist Party paved the way for greater respect for different opinions;

Considers it unacceptable that a number of people are still being prosecuted for violating Article 301 of the Criminal Code, and considers that a country where freedom of expression and freedom of the press are not fully guaranteed cannot be regarded as allowing the rule of law to prevail; stresses that the current procedure for the adoption of the Constitution must not prevent or delay abolition of Article 301 of the Criminal Code, as some people in positions of authority in Turkey have already suggested;

My question, then, is: specifically when does the Turkish regime intend to progress with democratising that country’s constitution and criminal code, to set free the leaders of HADEP and the Members of Parliament as well as all the political prisoners? Will the Kurdish issue ever be resolved, will all the political parties be allowed freedom of formation and operation and finally, will Turkey ever withdraw its troops from Cyprus?

This provision in the Criminal Code allowed, and still allows, a person who has served at least 15 years of his sentence for murder or high treason to apply to a jury for a reduction of the 10-year period left to serve on his minimum 25-year sentence.
