5. The Commission shall, for the duration of the first multiannual work programme, ensure geographical balance for projects other than integrated projects submitted under the sub-programme for Environment, by proportionately distributing funds among all Member States according to indicative national allocations established in accordance with the criteria set out in Annex I. Where indicative national allocations are not applicable, projects shall be selected exclusively on the basis of merit.

Obligations resulting from Section II of this Chapter concerning subsidiary undertakings, not themselves subject to this directive, shall not apply if the EU parent credit institution or credit institutions controlled by an EU parent financial holding company or EU parent mixed financial holding company, can demonstrate to the competent authorities that the application of Section II is unlawful under the laws of the third country where the subsidiary is established.
3. 1. The Commission may grant a derogation to the obligation laid down in Section 7.3.2.4 of Annex III concerning the mandatory equipment of lines with the European Train Control System (ETCS) in the context of EU funded projects (Section 7.3.2.4), when signalling is renewed on short (less than 150 km) and discontinuous sections of a line and provided that ETCS is installed before the earlier of these two dates:

· Budget allocation insufficiently focused on cross-border sections: It would appear that budget allocation is mainly driven by handing back their ’fair share’ of EU money to Member States and, therefore, lacks prioritisation; in addition, only nine out of 118 multiannual indicative programme (MIP) infrastructure project sections cover more than one Member State; the ECA claimed that the Commission did not give adequate funding priority to cross-border projects, whereas the Commission argued that projects were proposed and agreed upon by Member States; the Commission also highlighted insufficient financial means at European and Member State level;
