The applicant claims in that regard that, in tersely confirming in the contested decision that the error in the title of the amending decision of 31 December 2012 had no effect on the content of the decision itself or on the implementation of the programme, the Commission neglected to take into consideration the relevance of the following circumstances: (i) the spending decisions adopted by the Region had to be checked beforehand by the Court of Auditors; (ii) four months had elapsed between the correction being announced and the correction being implemented, without any explanation being provided; (iii) that fact had the potential to arouse the suspicion that the correction to be made was of greater importance than a correction supposedly relating only to the title of the decision of 31 December 2012; and (iv) the Court of Auditors had confirmed that the course of action taken by the Region, which refrained from adopting the commitments until the correction was officially recognised (28 March 2013), was correct, thus giving it to be understood that the opposite course of action would not have been correct.

Moreover, the procedure in which an application for international protection is examined should normally provide an applicant at least with: the right to stay pending a decision by the determining authority; access to the services of an interpreter for submitting his or her case if interviewed by the authorities; the opportunity to communicate with a representative of the United Nations High Commissioner for Refugees (UNHCR) and with organisations providing advice or counselling to applicants for international protection; the right to appropriate notification of a decision and of the reasons for that decision in fact and in law; the opportunity to consult a legal adviser or other counsellor; the right to be informed of his or her legal position at decisive moments in the course of the procedure, in a language which he or she understands or is reasonably supposed to understand; and, in the case of a negative decision, the right to an effective remedy before a court or a tribunal.

By its second plea, Freixenet claims that the Court infringed Article 7(1)(b) of Regulation No 40/94 by holding, in the judgments under appeal, that the Board of Appeal was not required to put forward specific evidence in support of its refusals to register and could merely affirm a supposedly well-known fact in denying the distinctive character of the marks for which registration was sought, when Freixenet had provided specific and substantiated information showing the original character of the marks at the relevant time, so that they varied significantly from the norm or customs of the sector concerned.

Urges the Egyptian authorities not to undermine the prospects recently opened up with regard, in particular, to multi-candidate presidential elections, and to press ahead with democratic reforms; expresses its deep concern, in this regard, about the conviction of Ayman Nour, a prominent liberal opposition leader, who has been recently sentenced to five years' hard labour by an Egyptian court for supposedly forging signatures on petitions used to create his political party; regards this as a seriously retrograde step and calls on the Egyptian authorities to make every effort to ensure that this case is correctly dealt with;
