Ralph Goodale: With regard to the Privy Council Office, and to the following documents: the Information to Obtain a Production Order and a Sealing Order, made on June 24th, 2013 by Corporal Greg Horton of the Royal Canadian Mounted Police in Ottawa, Ontario, before Chantal Dominique Marie Lurette, a Commissioner for the Taking of Oaths in the Province of Ontario, in which he states he has reasonable grounds to believe and does believe that offences contrary to an Act of Parliament have been made by Michael Duffy; the statements made in the Senate by Senator Michael Duffy on October 22, 2013, and statements made to the press on October 21, 2013 in Ottawa by Donald Bayne, a lawyer of that city acting on behalf of Senator Duffy: (a) does the Access to Information Directorate of the Privy Council Office still conclude that no records exist with regard to Access to Information requests A-2013-00231, A-2013-00232, A-2013-00233, A-2013-00075, A-2013-00076, A-2013-00077, A-2013-00080, A-2013-00085, A-2013-00099, A-2013-00101, A-2013-00103, A-2013-00104, A-2013-00105, A-2013-00106, A-2013-00113, A-2013-00114, A-2013-00116, A-2013-00120, A-2013-00125, A-2013-00126, A-2013-00131, A-2013-00132, A-2013-00139, and A-2012-00751; (b) will the Directorate re-examine the handling of those requests in light of the new information outlined above; (c) did the Privy Council Office formerly hold records which would have satisfied one or more of those requests; (d) if so, were the records transferred, removed, or destroyed; (e) if transferred or removed, to whose custody or control were they transferred or removed; (f) if destroyed, when were they destroyed, on what date or dates was the destruction approved, and what is the file number of any order, instruction, directive, or authorization concerning their transfer, removal, or destruction?

Question No. 1157 Mr. Rodger Cuzner: With respect to the Gabarus Seawall, also referred to in existing federal documents and plans as a groyne or breakwater, and all other properties built and previously or currently owned or administered by the government in Gabarus, Nova Scotia: (a) as a result of a Transfer of Duties Act based on an Order-in-Council (P.C. 1979-2522) September 20, 1979, (i) what specific properties, structures or facilities did Fisheries and Oceans Canada (DFO) acquire or become responsible for which were formerly owned or under the administration of the Department of Transport, (ii) did this specifically include a fishermen’s breakwater and two groynes and, if so, what specific structures in Gabarus did these terms refer to; (b) has there been any mechanism other than the Transfer Of Duties Act by which DFO took over ownership or administration of any other federal properties or facilities in Gabarus since 1979; (c) from 1979 to present, have there been evaluations, assessments or reports or other similar documents commissioned or received by DFO concerning these properties, structures or facilities, specifically the Gabarus Seawall and, if so, (i) what are the reference numbers and titles of said studies or assessments or other relevant documents including the dates they were performed and when they were released to DFO, (ii) under whose signature and authority; (d) have properties, facilities or structures or assets, specifically, the Gabarus Seawall, in Gabarus been divested by DFO since 1979 and, if so, (i) what asset, (ii) when did divestiture take place, (iii) to whom, (iv) by what process, regulations or Act of Parliament was it allowed, specifying all reference numbers, titles of agreements and details of maps, or other such relevant documents concerning the transfer; (e) since 1979 have there been efforts by DFO to divest itself of properties, structures, assets or facilities, specifically the Gabarus Seawall in Gabarus that have bee ...

They therefore needed to be supplemented firstly by Regulation (EC) No 1104/2008 and by Decision 2008/839/JHA and subsequently by this Regulation and Council Regulation (EU) No 1272/2012 of 20 December 2012 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) at the latest until the termination of the migration from SIS 1+ to SIS II or until a date to be fixed by the Council, acting in accordance with Regulation (EC) No 1987/2006 of the European Parliament and of the Council of 20 December 2006 on the establishment, operation and use of the second generation Schengen Information System (SIS II) and Council Decision 2007/533/JHA of 12 June 2007 on the establishment, operation and use of the second generation Schengen Information System (SIS II)

In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.
En 2006 et 2007, la Commission a présenté un ensemble complet de mesures législatives composé de trois instruments: la décision-cadre 2008/675/JAI du Conseil obligeant les États membres à prendre en compte les décisions de condamnation antérieures à l’occasion d’une nouvelle procédure pénale; la décision-cadre 2009/315/JAI du Conseil concernant l'organisation et le contenu des échanges d'informations extraites des casiers judiciaires; et la décision 2009/316/JAI du Conseil relative à la création de l’ECRIS comme moyen technique d’échanger des informations extraites des casiers judiciaires[47]. Devant être mises en œuvre au plus tard en avril 2012, les décisions-cadres 2009/315/JAI et 2009/316/JAI du Conseil visent à définir les procédures selon lesquelles un État membre prononçant une condamnation doit transmettre les informations relatives à une nouvelle condamnation à l’État membre ou aux États membres de nationalité de la personne condamnée, à préciser les obligations en matière de stockage et à arrêter un cadre pour un système informatisé d’échange d’informations.

For the public at large, in spite of over 500 community consultations in British Columbia and an open information process, in spite of the existence of the Treaty Negotiation Advisory Committee on which was represented every important business sector organization in the province, 35 member organizations in all, and in spite of the existence and involvement of advisory councils of citizens for wildlife, forestry, fisheries, mines, taxation, and self-government, and the role played by regional councils in the northwest part of British Columbia where the Nisga'a reside, still some who are fundamentally opposed to change will continue to say that the public was not informed or consulted and had no chance to present their views.
