4. The French Republic complains that, at paragraph 37 of the judgment under appeal, the General Court held that the contested decision had been adopted in breach of the principles relating to the rights of the defence, inasmuch as the Council had adopted the decision without first informing the PMOI of the new information or new material in the file which, in its view, justified the continued inclusion of the PMOI in the list referred to in Article 2(3) of Regulation No 2580/2001.

First plea in law, alleging a manifest error of assessment in relation to the exception concerning the protection of court proceedings laid down in the second indent of Article 4(2) of Regulation No 1049/2001 (1), in so far as the Court had already held, in Jurašinović v Council (T-63/10, EU:T:2012:516) — in implementation of which the contested decision was adopted — that although that exception was applicable, it could not operate in the present case.

It pointed out that the Working Time Directive was adopted as a health and safety directive, and held that the Council had acted outside its powers in including the provision on Sunday, since it had 'failed to explain why Sunday, as a weekly rest day, is more closely connected with the health and safety of workers than any other day of the week'.

It is now clear that it would have been better if the European Parliament had held an extraordinary session earlier on the subject of Georgia. It is a shame that we did not present our position during a Council sitting.
Il est clair à présent qu'il aurait mieux valu que le Parlement européen organise plus tôt une séance extraordinaire sur le sujet de la Géorgie. Il est dommage que nous n'ayons pas présenté notre position lors d'une séance du Conseil.
