Ireland is taking part in this [instrument] in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 6(2) of Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen acquis*.

4. Notes with satisfaction that the European Court of Justice recently annulled the original legal basis, following contestation by Parliament, and ruled that in these cases the codecision procedure should apply under Articles 179 and 189a of the EC Treaty; stresses that the review of ENPI and the adoption of a regulation replacing the annulled Council Decision on a Community guarantee of EIB loans, have to be conducted in parallel since they are complementary instruments with regards to EU policy towards neighbouring countries and contradictory or counter-effective provisions need to be avoided;
4. constate avec satisfaction que la Cour de justice européenne a récemment annulé la base juridique originelle à la suite de sa contestation par le Parlement et qu'elle a statué que, dans ces cas, la procédure de codécision s'appliquait en vertu des articles 179 et 189 A du traité CE; souligne que le réexamen de l'IEVP et l'adoption d'un règlement remplaçant la décision du Conseil relative à la garantie communautaire des prêts de la BEI qui a été annulée doivent avoir lieu en parallèle étant donné qu'il s'agit d'instruments complémentaires de la politique de l'Union européenne à l'égard de ses voisins et qu'il faut éviter l'existence de dispositions contradictoires ou nuisant à son efficacité;

Consequently, the Conciliation Committee will be convened in accordance with the provisions governing the co-decision procedure between the European Parliament and the Council (Article 189a of the Treaty).
