Given that the standard of proof necessary to exclude someone from the asylum procedure is not as high as that needed to either to bring about a criminal trial or a conviction, there are cases in which individuals are excludable from the asylum system but unable to be tried as there is not enough evidence for a criminal trial or have been found innocent.
