(7) On 27 September 1968 the then Member States of the European Communities, acting under Article 293, fourth indent, of the Treaty establishing the European Community, concluded the Brussels Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, subsequently amended by conventions on the accession to that Convention of new Member States (hereinafter referred to as the ‘1968 Brussels Convention’).

On 16 September 1988 the then Member States of the European Communities and certain EFTA States concluded the Lugano Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters (hereinafter referred to as the ‘1988 Lugano Convention’), which is a parallel Convention to the 1968 Brussels Convention.

The 1988 Lugano Convention was revised by the Convention on Jurisdiction and the Recognition and Enforcement of Judgments in Civil and Commercial Matters, done at Lugano on 30 October 2007 by the Union, Denmark, Iceland, Norway and Switzerland (hereinafter referred to as the ‘2007 Lugano Convention’).

This Directive shall not affect the application of Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, nor of Council Regulation (EC) No 2201/2003 on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and in matters of parental responsibility for joint children, repealing Regulation (EC) No 1347/2000, nor of the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children, nor of the 1980 Hague Convention on the Civil Aspects of International Child Abduction.

La présente directive n'a pas d'incidence sur l'application du règlement (CE) nº 44/2001du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, sur celle du règlement (CE) nº 2201/2003 du Conseil relatif à la compétence, la reconnaissance et l'exécution des décisions en matière matrimoniale et en matière de responsabilité parentale abrogeant le règlement (CE) n° 1347/2000, sur celle de la Convention de La Haye de 1996 concernant la compétence, la loi applicable, la reconnaissance, l'exécution et la coopération en matière de responsabilité parentale et de mesures de protection des enfants, ni sur celle de la Convention de La Haye de 1980 sur les aspects civils de l'enlèvement international d'enfants.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

La présente convention ne préjuge pas l'application par les États membres de la Communauté européenne du règlement (CE) no 44/2001 du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, et de toute modification apportée à celui-ci, de la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, et du protocole concernant l'interprétation de cette convention par la Cour de justice des Communautés européennes, signé à Luxembourg le 3 juin 1971, tels qu'ils ont été modifiés par les conventions d'adhésion à ladite convention et audit protocole par les États adhérant aux Communautés européennes, ainsi que de l'accord entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, signé à Bruxelles le 19 octobre 2005.

7. Insofar as the relations between the Member States of the European Community and the non-European territories referred to in Article 70(1)(b) are concerned, this Convention shall replace the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as of the date of the entry into force of this Convention with respect to these territories in accordance with Article 73(2).

4. If the parties have agreed to attribute exclusive jurisdiction to a court or courts of a State party to the Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (18), signed on 30 October 2007 in Lugano (hereinafter referred to as the Lugano Convention), where that State is not a Member State, the said Convention shall apply except in the case of the disputes referred to in paragraph 3.

Si les parties sont convenues d’attribuer une compétence exclusive à une juridiction ou aux juridictions d’un État partie à la convention concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale (18), signée le 30 octobre 2007 à Lugano (ci-après dénommée «la convention de Lugano»), dès lors que celui-ci n’est pas un État membre, ladite convention s’applique sauf en ce qui concerne les litiges visés au paragraphe 3.

On 27 September 1968 the Member States, acting under Article 293, fourth indent, of the EC Treaty, concluded the Brussels Convention on jurisdiction and enforcement of judgments in civil and commercial matters (“the Brussels Convention”). Given that that Convention, which is part of the acquis communautaire and has been extended to all the new Member States, may continue to apply as between Denmark and the other Member States, this Regulation was adopted only following the amendment of the Brussels Convention in line with the provisions of this Regulation.

Unless otherwise specified in this Regulation, the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed in Brussels on 27 September 1968, as amended by the Conventions on the Accession to that Convention of the States acceding to the European Communities, the whole of which Convention and of which Conventions of Accession are hereinafter referred to as the 'Convention on Jurisdiction and Enforcement`, shall apply to proceedings relating to Community trade marks and applications for Community trade marks, as well as to proceedings relating to simultaneous and successive actions on the basis of Community trade marks and national trade marks.

À moins que le présent règlement n'en dispose autrement, les dispositions de la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, telle que modifiée par les conventions relatives à l'adhésion à cette convention des États adhérents aux Communautés européennes, l'ensemble de cette convention et de ces conventions d'adhésion étant ci-après dénommé «la convention d'exécution», sont applicables aux procédures concernant les marques communautaires et les demandes de marque communautaire ainsi qu'aux procédures concernant les actions simultanées ou successives menées sur la base de marques communautaires et de marques nationales.
