The purpose of this proposal is to: - impose, as of 1 January 1998, the provisions of the Torremolinos Convention of 1977 and its 1993 Protocol to fishing vessels flying the flag of a Member State of a length of 24 metres and above, as well as to fishing vessels of a third country operating in the internal waters or territorial seas of a Member State or landing their catch in a port of a Member State; this Protocol concerns, in particular, the certification, construction and equipment, stability, machinery installations, fire protection, protection of the crew, life-saving appliances, emergency procedures, radio-communications and navigational equipment of fishing vessels; - extend, to fishing vessels between 24 and 45 metres in length built after 1 January 1998, the requirements of the Torremolinos Convention that only apply to vessels of more than 45 metres; - impose certain general and regional additional requirements over and above those of the Torremolinos Protocol; - to have a committee procedure used to adopt harmonized interpretations for the 200 provisions of the Protocol providing for a discretionary decision by the contracting parties.
Cette proposition a comme objectifs : - de rendre obligatoires, à partir du 1er janvier 1998, les dispositions de la convention de Torremolinos de 1977 et de son protocole de 1993 pour les navires de pêche battant pavillon d'un Etat membre et ayant une longueur égale ou supérieure à 24 mètres, ainsi que pour les navires de pêche de pays tiers en exploitation dans les eaux intérieures ou les mers territoriales d'un Etat membre ou débarquant leurs prises dans un port d'un Etat membre; ce protocole traite notamment de la certification, de la construction et de l'équipement, de la stabilité, des machines et installations, de la prévention de l'incendie, de la protection de l'équipage , des dispositifs de sauvetage, des procédures d'urgence, des radiocommunications et des appareils de navigation des navires de pêche; - d'étendre aux navires de pêche d'une longueur de 24 à 45 mètres construits après le 1er janvier 1998 les dispositions de la convention de Torremolinos qui ne s'appliquent qu'aux navires d'une longueur supérieure à 45 mètres; - de fixer quelques prescriptions supplémentaires, de portée générale ou régionale, en plus des dispositions du protocole de Torremolinos; - de décider de recourir à une procédure de comité pour arrêter des interprétations harmonisées, en ce qui concerne la Communauté, des 200 dispositions du protocole prévoyant que les parties contractantes ont un pouvoir discrétionnaire de décision.
