Subject to paragraph 4, the aggregate amount of the annual contributions payable in respect of contributing oil received in a single Contracting State during a calendar year shall not exceed 20% of the total amount of annual contributions pursuant to this Protocol in respect of that calendar year.

The sums referred to in paragraph 2 shall be arrived at by dividing the relevant total amount of contributions by the total amount of contributing oil or hazardous and noxious substances received in all Member States in the relevant year, after taking into account the shipowner's contribution under Part 1 of the COPE Fund .
