Likewise, in its Decision No 96-385 DC of 30 December 1996, the Constitutional Council pointed out that the flat-rate contribution of FRF 37,5 billion was justified by the State financing of the retirement pensions of the civil servants, without constituting compensation, whereas, on the other hand, the payments to the State budget would not be earmarked for a specific expenditure and would contribute to the general conditions for the balance of this budget, in accordance with Article 18 of the Ordinance of 2 January 1959 on the Organic Law relating to Finance Bills (ordonnance organique du 2 janvier 1959 relative aux lois de finances).

As regards Iceland and Norway, this Regulation constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters’ association with the implementation, application and development of the Schengen acquis (3), which falls within the area referred to in Article 1, point (B) of Council Decision 1999/437/EC (4).

The Council points out that, in accordance with Article 6 of the EU Treaty, the institutions of the Union are required to respect fundamental rights, as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms and as they result from the constitutional traditions common to the Member States, when exercising powers conferred on them by the Treaties, whether or not those powers are being exercised on the initiative of a Member State.

Will the Council point out to Turkey that the threat of war against a Member State in the event of its implementing the Community acquis relating to the Law of the Sea constitutes an intolerable situation?

I therefore feel that we can look forward more positively to the June European Council, which of course will not be able to resolve the constitutional question, but which will certainly be able to point the way forward towards defining Europe’s future. The Commission is working actively with the Council to this end and we hope to be able to make a worthwhile contribution.
Par conséquent, j’estime que nous pouvons envisager avec plus d’optimisme le Conseil européen de juin, qui ne pourra bien sûr pas résoudre la question constitutionnelle mais qui sera certainement en mesure d’indiquer la direction à suivre pour définir l’avenir de l’Europe.
