The United Kingdom is taking part in this [INSTRUMENT], in accordance with Article 5(1) of Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*.

c. during that trip the fishing vessel concerned uses one type of regulated gear on board and that gear is listed in accordance with paragraph 2; if the vessel carries other gear on board during the fishing trip, it shall be stowed in accordance with Article 47 of Regulation (EC) No 1224/2009.

2. So far as concerns articles stowed on the outside of the vehicle, including the boxes referred to in paragraph 1, the carrier shall be liable in respect of articles placed on the outside of the vehicle only if it is proved that the loss or damage results from an act or omission, which the carrier has committed either with intent to cause such a loss or damage or recklessly and with knowledge that such loss or damage would probably result.
2. En ce qui concerne les objets arrimés à l’extérieur du véhicule y compris les coffres visés au paragraphe 1, le transporteur n’est responsable que s’il est prouvé que le dommage résulte d’un acte ou d’une omission que le transporteur a commis, soit avec l’intention de provoquer un tel dommage, soit témérairement et avec conscience qu’un tel dommage en résulterait probablement.

However, fishing vessels also fishing in fishing areas other than those referred to in paragraph 1 during the same trip may carry gear corresponding to their activities in the areas concerned, provided that gear kept on board and not authorised for use in the fishing areas referred to in paragraph 1 is stowed so that it may not be readily used, in accordance with the second subparagraph of Article 20(1)".

Toutefois, les navires de pêche qui, au cours d'une même sortie pêchent aussi dans les zones de pêche autres que celles visées au paragraphe 1 peuvent emporter les engins correspondant à leurs activités dans les zones concernées à condition que les engins se trouvant à bord et dont l'utilisation n'est pas autorisée dans la ou les zone(s) de pêche visée(s) au paragraphe 1 soient rangés de façon à ne pas être facilement utilisables conformément à l'article 20, paragraphe 1, deuxième alinéa".
