By 12 January 2012, the Commission shall, on the basis of information supplied by the Member States on the practical application of the provisions implementing this framework Decision, submit a report to the Council and make any proposals it deems appropriate which may include proposals to the effect that Member States shall, concerning offences committed in their territorial sea or in their exclusive economic zone or equivalent zone, consider a ship flying the flag of another Member State not to be a foreign ship within the meaning of Article 230 of the 1982 United Nations Convention on the Law of the Sea.

4. Notwithstanding Article 5(6), a Member State may, if circumstances require, allow a seafarer to serve in a capacity other than radio officer or radio operator, except as provided by the Radio Regulations, for a period not exceeding three months on board a ship flying its flag, while holding an appropriate and valid certificate issued and endorsed as required by a third country, but not yet endorsed for recognition by the Member State concerned so as to render it appropriate for service on board a ship flying its flag.
4. Nonobstant l'article 5, paragraphe 6, un État membre peut, si les circonstances l'exigent, autoriser des gens de mer à servir à bord d'un navire battant son pavillon dans une capacité autre que celle d'officier radioélectricien ou d'opérateur des radiocommunications, sous réserve des dispositions du règlement des radiocommunications, pour une période ne dépassant pas trois mois, s'ils sont titulaires d'un brevet approprié et valide qu'un pays tiers a délivré et visé de la manière prescrite mais qui n'a pas encore été visé pour reconnaissance par l'État membre concerné en vue de le rendre approprié pour les services à bord des navires battant son pavillon.
