Definition: A group of disorders in which anxiety is evoked only, or predominantly, in certain well-defined situations that are not currently dangerous. IN-CONTEXT TRANSLATIONS

WHEREAS the Council of the European Union has adopted Council Regulation (EC) No 2725/2000 of 11 December 2000 concerning the establishment of ‘Eurodac’ for the comparison of fingerprints for the effective application of the Dublin Convention with a view to helping to determine the Contracting Party responsible for examining an asylum application in accordance with the Dublin Convention (hereinafter referred to as the Eurodac Regulation) and Council Regulation (EC) No 407/2002 of 28 February 2002 laying down certain rules to implement Regulation (EC) No 2725/2000 concerning the establishment of ‘Eurodac’ for the comparison of fingerprints for the effective application of the Dublin Convention (hereinafter referred to as the Eurodac implementing Regulation).

(9) Whereas, therefore, the Commission should be empowered to replace the existing legislation with legislation which is simpler, more flexible and better targeted, and which may cover all types of vertical agreements; whereas if the scope of the exemption regulation covering such agreements is to be broadened in this way, there should be criteria such as market-share thresholds to specify the circumstances where, in view of the possible economic effects of the agreements, the regulation ceases to be applicable; whereas the setting of such market share thresholds should take account of the market power of the undertaking concerned; whereas certain severe anticompetitive vertical restraints like minium and fixed resale prices and certain types of territorial protection should be excluded from the application of the regulation irrespective of the market share of the undertaking concerned;

Whereas certain ruminant tissues should be designated as specified risk materials on the basis of the pathogenesis of TSEs and the epidemiological status of the country or region of origin or residence of the animal concerned, whereas the specified risk materials should be removed and disposed of in a manner which avoids any risk to human or animal health; whereas, in particular, they should not placed on the market for human food, animal feed or fertiliser; whereas, however, provision should be made for an equivalent level of health protection to be achieved by means of a test for TSEs carried out on individual animals, once such test have been fully validated ; whereas slaughter techniques presenting a risk of causing brain material to contaminate other tissues should not be permitted in countries or regions other than those presenting no BSE;

WHEREAS COUNCIL REGULATION ( EEC ) NO 447/68 ( 3 ) OF 9 APRIL 1968 LAYING DOWN GENERAL RULES FOR INTERVENTION BUYING OF SUGAR , AS LAST AMENDED BY REGULATION ( EEC ) NO 2274/70 , ( 4 ) PROVIDES THAT SUGAR SHALL BE SOLD BY INTERVENTION AGENCIES EITHER BY TENDER OR BY ANOTHER SALES PROCEDURE , BUT BY TENDER ONLY WHEN THE SUGAR IS INTENDED FOR ANIMAL FEED OR EXPORT ; WHEREAS CERTAIN DETAILED RULES CONCERNING SALE BY TENDER WERE LAID DOWN BY COMMISSION REGULATION ( EEC ) NO 1987/69 ( 5 ) OF 8 OCTOBER 1969 LAYING DOWN DETAILED RULES CONCERNING THE SALE BY TENDER OF SUGAR BY INTERVENTION AGENCIES ; WHEREAS IN VIEW OF CHANGES WHICH HAVE BEEN MADE TO THE RULES GOVERNING DENATURING AND OF THE PROCEDURE FOLLOWED FOR SALES BY TENDER FOR TWO SUGAR MARKETING YEARS , IN PARTICULAR AS REGARDS REMOVAL AND PAYMENT , IMPORTANT AMENDMENTS HAVE BECOME NECESSARY ; WHEREAS , IN THE INTERESTS OF CLARITY , THE DETAILED RULES FOR THE SALE BY TENDER OF SUGAR BY INTERVENTION AGENCIES SHOULD THEREFORE BE INCORPORATED IN A NEW REGULATION ;
considérant que le règlement (CEE) nº 447/68 du Conseil, du 9 avril 1968, établissant les règles générales en matière d'intervention par achat dans le secteur du sucre (3), modifié en dernier lieu par le règlement (CEE) nº 2274/70 (4), prévoit que la mise en vente de sucre par les organismes d'intervention se fait par adjudication ou par un autre processus de vente et seulement par adjudication lorsque le sucre est destiné à l'alimentation des animaux ou à l'exportation ; que certaines modalités pour la mise en vente par adjudication ont été arrêtées par le règlement (CEE) nº 1987/69 de la Commission, du 8 octobre 1969, établissant des modalités d'application en ce qui concerne la vente de sucre par adjudication par les organismes d'intervention (5) ; que, eu égard d'une part, aux changements intervenus dans la réglementation régissant le domaine de la dénaturation et, d'autre part, aux pratiques suivies en matière de ventes par adjudication depuis deux campagnes sucrières, notamment en ce qui concerne l'enlèvement et le paiement, des modifications importantes s'avèrent nécessaires ; qu'il convient, dès lors, notamment pour des raisons de clarté, de fondre dans un nouveau règlement les modalités d'application en matière de vente de sucre par adjudication par les organismes d'intervention;
