Considers that, should the notion of concentration be finally enlarged, special attention should be attached to the capacity of exercising decisive influence on the market that certain agreements between companies might entail, as this possibility will determine the final treatment of an operation as an agreement under article 81 or as a concentration under the Merger Regulation. In any case, the possible effects that the current proposal of modification of Regulation 17/1962 could have on the required analysis of this kind of operations (i.e. the disappearance of the current notification system), must be borne in mind;
