As regards ADRs conducted by a court, the Member States' codes of civil procedure allow for the possibility of seising a judge principally concerned with conciliation, [55] make conciliation the compulsory phase of the procedure [56] or explicitly encourage judges to intervene actively in the search for an agreement between the parties.
