(2) If a person is the builder of a complex, the Minister shall pay a rebate in respect of the complex to the person under subsection 256.21(1) of the Act, the amount of which is determined under subsection 56(4) or 57(4), only if the Minister is satisfied, by a certificate, statement or other documentary evidence as the Minister may require, that the person is in good standing with respect to the payment of all taxes, and fees relating to the construction activities of the builder, imposed under an Act of the legislature of the province in which the residential complex is situated.

Section 35 and subsections 36(2) to (5) apply in respect of a building, or a part of a building, in which a residential unit forming part of a residential complex is situated if the builder of the complex is deemed under section 191 of the Act to have made a supply of the complex after March 31, 2013.

(35a) While recognising that Community legislation must take on board the specific situation of small and medium sized manufacturing enterprises in relation to administrative burdens, it is necessary that, rather than providing for general exceptions and derogations for these enterprises which can only lead to the impression of secondary or sub-quality products or economic operators and to a complex legal situation for the national market surveillance authorities to supervise, Community legislation should provide for the situation of these enterprises to be taken on board in the rules for the selection and implementation of the most appropriate conformity assessment procedures and in the obligations placed on conformity assessment bodies to operate in a proportionate manner in relation to the size of undertakings and to the small serial or non-serial nature of the production concerned.

30. Stresses the risk of maintaining the death penalty in a complex political situation, such as the Kashmir dispute, where the right to a fair trial does not appear to be guaranteed; notes with concern that South Asia continues to have a poor record with regard to the death penalty and deeply regrets that both the Indian and the Pakistani Governments are in favour of its retention; welcomes the fact that key abolitionist voices in the region include President Kalam and the newly appointed Chief Justice to the Supreme Court in India; welcomes UN Human Rights Resolution 2005/59 on the question of the death penalty and reaffirms the EU's human rights guidelines on the death penalty; urges India and Pakistan to consider acceding to the Second Optional Protocol to the ICCPR, and similar regional instruments with a view to introducing a moratorium on the death penalty, and to move towards complete abolition;
