The association of tomato producers in Serres has written to the Community officials responsible for carrying out checks on industrial tomatoes in the Serres region (Pilar Ramírez and Frederico Spanu) to complain that the companies, AXACO and ARGO, with the complicity of Greek government departments and the banks, made it appear that they had processed many times more than the actual amounts of industrial tomatoes in order to obtain Community subsidies illegally for the non-existent quantities.

(10) After the complaint was lodged, and while the preliminary investigations were already under way, one of the complainant Community producers informed the Commission that, having closed its APT shop in July 1987, it no longer wished to be considered a complainant, although it was prepared to be used as a 'reference' for the injury.

The Commission further concluded, on the basis of the following facts, that the Community industry had suffered material injury: - imports of audio cassettes from Japan, Korea and Hong Kong have increased at a more rapid rate than the rate of global consumption, from 154 million units in 1985 to 212 million units in 1988 (some US$ 450 million), namely by 38%; - the market share of the exporters found to have practised dumping increased by 10% while the market share of the total dumped imports increased by 3%; - the complainant producers' selling prices in the Community suffered a significant erosion between 1985 and 1988; - Community producers were unable to increase significantly their production between 1985 and 1988 and their sales fell by 8.5% over this period, despite an increase in total consumption of 30%; - between 1985 and 1988 return on sales of the Community industry showed a constant negative trend, which has been improved in 1988 mainly because of the withdrawal of the loss-making models; - these rationalization measures involved a loss of employment in the Community of some 23% of the audio cassettes workforce between 1985 and 1988.
Ils ont permis en outre à la Commission de conclure que l'industrie communautaire a subi un important préjudice en raison des éléments suivants : - les importations de cassettes audio du Japon, de la Corée et de Hong Kong ont augmenté à un rythme plus rapide que celui de la consommation globale et sont passées de 154 millions d'unités en 1985 à 212 millions d'unités en 1988 (+/- 450 millions de dollars), soit une progression de 38%; - la part de marché détenue par les exportateurs ayant pratiqué le dumping a augmenté de 10 % et celle représentée par les importations totales en dumping a progressé de 3%; - les prix de vente des producteurs plaignants de la Communauté ont subi une érosion significative de 1985 à 1988; - les producteurs communautaires n'ont pas été en mesure d'accroître leur production de façon sensible entre 1985 et 1988, et leurs ventes ont régressé de 8,5 % pendant cette période, en dépit d'une augmentation de 30 % de la consommation totale; - de 1985 à 1988, le rendement des ventes de l'industrie communautaire a affiché une tendance négative constante qui s'est redressée en 1988 par suite de l'abandon des modèles vendus à perte; - ces mesures de rationalisation ont entraîné une perte d'emplois représentant environ 23 % des effectifs de l'industrie communautaire des cassettes audio entre 1985 et 1988.

In June 2002, the complainant withdrew its complaint, the Community producer having ceased its production.
