2. If, nevertheless, such a derogation or restrictive clause is applied in respect of a passenger, or if the passenger is not correctly informed of his rights and for that reason has accepted compensation which is inferior to that provided for in this Regulation, the passenger shall still be entitled to take the necessary proceedings before the competent courts or bodies in order to obtain additional compensation.

(20) The minimum standard should cover the restrictions which Member States are authorised to apply to the award of state-funded compensation, in particular when those restrictions relate to obligations on the part of the crime victim, including the need for the victim to report the crime to the police and to make the application for compensation within a certain time, in order to ensure equal treatment of all crime victims in the European Union.

(20) The minimum standard should cover the restrictions that can be placed on the award of compensation, in particular when those restrictions relate to obligations on the part of the crime victim, including the need for the victim to report the crime to the police and to make the application for compensation within a certain time, in order to ensure equal treatment of all crime victims in the European Union.

In cases where passengers receive no compensation and in the case described above, passengers shall be awarded compensation for all the costs they have incurred, including legal advisers' fees, if the competent authority deems that the compensation provided for pursuant to the derogation or restrictive clause in the contract of carriage or the contract in which they have accepted inferior compensation, manifestly does not constitute fair compensation.
