Regulation (EC) No 717/2007 of the European Parliament and of the Council of 27 June 2007 on roaming on public mobile communications networks within the Community complements and supports, in so far as Community-wide roaming is concerned, the rules provided for by the EU regulatory framework for electronic communications.
Le règlement (CE) no 717/2007 du Parlement européen et du Conseil du 27 juin 2007 concernant l’itinérance sur les réseaux publics de communications mobiles à l’intérieur de la Communauté complète et renforce, en ce qui concerne l’itinérance communautaire, les règles contenues dans le cadre réglementaire de l’Union européenne pour les communications électroniques.

Since this Regulation provides that the Directives making up the 2002 regulatory framework for electronic communications are without prejudice to any specific measure adopted for the regulation of Community-wide roaming charges for mobile voice telephony calls, and since providers of Community-wide roaming services may be required by this Regulation to make changes to their retail roaming tariffs in order to comply with the requirements of this Regulation, such changes should not trigger for mobile customers any right under national laws transposing the 2002 regulatory framework for electronic communications to withdraw from their contracts.

This Regulation is not an isolated measure, but complements and supports, insofar as Community-wide roaming is concerned, the rules provided for by the 2002 regulatory framework for electronic communications.

In addition to the Eurotariff provided for in paragraph 1, every home provider should offer a fair-use, all-inclusive monthly flat-rate to which no charge limits apply. The flat rate should cover Community-wide roaming voice and data communication services (including Short Message Service (SMS) and Multimedia Messaging Service (MMS)) within the Community.

However, the work undertaken by the national regulatory authorities (both individually and in the European Regulators Group) in analysing the wholesale national markets for Community-wide roaming has demonstrated that it has not yet been possible for a national regulatory authority to address effectively the high level of wholesale Community-wide roaming charges because of the difficulty in identifying undertakings with significant market power in view of the specific circumstances of Community-wide roaming, including its cross-border nature.

(fa) “Community-wide roaming data communication service” means a public mobile telephony service, distinct from mobile voice telephony, that is provided via a terrestrial public mobile telephony network located within a Member state and which roaming customers can use by means of arrangements between the home network operator and the operator of the visited network.
(f bis) "service de communication de données en itinérance communautaire", un service de téléphonie mobile public distinct des services de communication vocale mobiles, proposé par l'intermédiaire d'un réseau de téléphonie mobile public terrestre situé à l'intérieur d'un État membre et pouvant être utilisé par un abonné itinérant par l'intermédiaire d'arrangements entre l'opérateur du réseau de rattachement et l'opérateur du réseau visité.

1a. For the purpose of providing Community-wide roaming services every home provider shall have access to and use of the terrestrial public mobile telephony networks situated in the Member States other than that of the home network.
