The first issue in this context is whether it should be left for the market to develop Community-wide licensing further, while respecting the basic rules of intellectual property protection, including its territorial nature, or whether the Community legislator should seek to facilitate greater Community-wide licensing.

This Regulation introduces a common approach to ensuring that users of public mobile communications networks when travelling within the Community do not pay excessive prices for Community-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.
Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l’intérieur de la Communauté ne paient pas un prix excessif pour les services d’itinérance communautaire, par comparaison avec les prix nationaux concurrentiels, lorsqu’ils passent et reçoivent des appels, envoient et reçoivent des SMS et utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en favorisant la concurrence et la transparence sur le marché et en offrant à la fois des incitations à l’innovation et un choix aux consommateurs.

The Commission should review the effectiveness of this Regulation and the contribution which it makes to the implementation of the regulatory framework and the smooth functioning of the internal market and also examine the impact of this Regulation on the smaller mobile telephony providers in the Community and their position in the Community-wide roaming market,

(8) Whereas in order to create a favourable climate for investment and deployment of UMTS and to allow the development of Community-wide as well as pan-European and global services with the widest possible territorial coverage, early and specific action at Community level is necessary; whereas Member States should allow the rapid and coordinated introduction of compatible UMTS networks and services in the Community on the basis of internal market principles and pursuant to European standards for UMTS approved or developed by the European Telecommunications Standards Institute (ETSI), where available, including in particular a common, open and internationally competitive air-interface standard; whereas diverging national laws, regulations and administrative action would hinder or prevent the provision of Community-wide and global UMTS services and the free movement of related equipment;
(8) considérant que, pour créer un climat favorable à l'investissement et au déploiement de l'UMTS et pour permettre le développement de services non seulement communautaires mais aussi paneuropéens et mondiaux couvrant un territoire aussi vaste que possible, des mesures rapides et spécifiques doivent être prises au niveau communautaire; que les États membres doivent permettre l'introduction rapide et coordonnée dans la Commission de réseaux et de services UMTS compatibles sur la base des principes du marché intérieur et conformément aux normes européennes relatives à l'UMTS approuvées ou élaborées par l'Institut européen de normalisation des télécommunications (ETSI), lorsque celles-ci existent, y compris notamment une norme d'interface radio commune, ouverte et concurrentielle au plan international; que l'existence de divergences entre les dispositions législatives ou réglementaires nationales, ou entre les mesures administratives nationales, entraverait ou empêcherait la fourniture de services UMTS communautaires et mondiaux et la libre circulation des équipements qui leur seraient associés;

Whereas the authorizations granted to investment firms by the competent national authorities pursuant to this Directive will have Community-wide, and no longer merely nationwide application, and existing reciprocity clauses will henceforth have no effect; whereas a flexible procedure is therefore needed to make it possible to assess reciprocity on a Community basis; whereas the aim of this procedure is not to close the Community's financial markets but rather, as the Community intends to keep its financial markets open to the rest of the world, to improve the liberalization of the global financial markets in third countries; whereas, to that end, this Directive provides for procedures for negotiating with third countries and, as a last resort, for the possibility of taking measures involving the suspension of new applications for authorization and the restriction of new authorizations;
