The Commission had adopted the principle of refusing to reimburse Community co-financing which exceeds the level set in the programme complement, considering that this 'front-loading' of Community part-financing exposed it to the risk that the rate set would not be respected in the long run, so proportionately reducing the multiplier effect sought.
La Commission a eu pour principe de refuser le remboursement du cofinancement communautaire qui dépasse le taux prévu au complément de programmation, estimant que ce « front-loading » du cofinancement communautaire l'expose au risque que le taux prévu ne serait pas respecté à terme, réduisant d'autant l'effet de levier recherché.

For the Community actions financed under the programme, Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated on the basis of the programme, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Communities or budgets managed by them, by an unjustified item of expenditure.

For the Community actions financed under this decision, the notion of irregularity referred to in Article 1, paragraph 2 of Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities financial interests shall mean any infringement of a provision of Community law or any breach of a contractual obligation resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Communities or allocations managed by them, by an unjustified item of expenditure.

More specifically, the programme would finance appropriate actions involving, in a coherent way, national and regional Community co-operation and development strategies regarding the third countries concerned and complete the actions – in particular in the fields of migration, asylum, border control, refugees and displaced people – provided for in implementation of those strategies and financed from other Community instruments.

Calls for the 'polluter pays' principle to be fully enforced at sea by means of a criminal-liability scheme enabling those responsible for incidents to be penalised and further developing an international compensation fund system, based on the ‘polluter pays’ principle, intended to compensate coastal communities and finance the cleaning up of the environment. The financing of the fund would be spread over the entire transport chain (flag states, charterers, the owners of the cargo and the owners of the vessel). The fund would consist of two parts: one relating to the carriage of hydrocarbons and the other to the carriage of other hazardous substances;
22. requiert la pleine application du principe du "pollueur-payeur" en milieu marin par un système de responsabilité pénale propre, d'une part, à pénaliser les responsables d'incidents et d'autre part, à développer encore, conformément audit principe, un système de fonds de compensation international afin de dédommager les riverains et de financer la restauration de l'environnement; le financement de ce fonds s'étendrait sur toute la chaîne du transport (États de pavillon, affréteurs, propriétaires de la cargaison et propriétaires du bateau); recommande que ce fonds soit composé de deux parties, l'une relative au transport d'hydrocarbures, et l'autre relative au transport d'autres substances dangereuses;

Community co-financing would be limited to a maximum of 70% except for specific projects and complementary measures, which could receive funding up to 100%. However, the proportion of appropriations dedicated to specific projects would be restricted to 10% of the annual budget, with an additional 10% set aside for complementary measures.
