Member States may verify whether the concerned vacancy could not be filled by national or Community workforce, by third-country nationals lawfully resident in that Member State and already forming part of its labour market by virtue of Community or national law, or by EC long-term residents wishing to move to that Member State for highly qualified employment in accordance with Chapter III of Directive 2003/109/EC.
Les États membres peuvent vérifier si le poste vacant ne pourrait pas être occupé par de la main-d’œuvre nationale ou communautaire, par un ressortissant de pays tiers en séjour régulier dans l’État membre en question et qui appartient déjà au marché du travail dans cet État membre en vertu de la législation communautaire ou nationale, ou par un résident de longue durée — CE désireux de se rendre dans cet État membre pour y occuper un emploi hautement qualifié, conformément au chapitre III de la directive 2003/109/CE.

4. The management of every undertaking belonging to the Community-scale group of undertakings and the central management or the deemed central management within the meaning of the second subparagraph of paragraph 2 of the Community-scale undertaking or group of undertakings shall be responsible for obtaining and transmitting to the parties concerned by the application of this Directive the information required for commencing the negotiations referred to in Article 5, and in particular the information concerning the structure of the undertaking or the group and its workforce.
4. Toute direction d’une entreprise comprise dans le groupe d’entreprises de dimension communautaire ainsi que la direction centrale ou la direction centrale présumée au sens du paragraphe 2, deuxième alinéa, de l’entreprise ou du groupe d’entreprises de dimension communautaire est responsable de l’obtention et de la transmission aux parties intéressées par l’application de la présente directive des informations indispensables à l’ouverture de négociations visées à l’article 5, particulièrement les informations relatives à la structure de l’entreprise ou du groupe et à ses effectifs.

Article 125 of the Treaty establishing the European Community states that Member States and the Community shall work towards developing a coordinated strategy for employment and particularly for promoting a skilled, trained and adaptable workforce and labour markets responsive to economic change.
Selon l’article 125 du traité instituant la Communauté européenne, les États membres et la Communauté s’attachent à élaborer une stratégie coordonnée pour l’emploi et en particulier à promouvoir une main-d’œuvre qualifiée, formée et susceptible de s’adapter, ainsi que des marchés du travail aptes à réagir rapidement à l’évolution de l’économie.

Without prejudice to paragraph 2, the obligations arising from this Directive shall not apply to Community-scale undertakings or Community-scale groups of undertakings in which, on the date laid down in Article 14 (1) for the implementation of this Directive or the date of its transposition in the Member State in question, where this is earlier than the abovementioned date, there is already an agreement, covering the entire workforce, providing for the transnational information and consultation of employees.
Sans préjudice du paragraphe 2, les entreprises de dimension communautaire et les groupes d'entreprises de dimension communautaire dans lesquels il existe déjà, soit à la date prévue à l'article 14 paragraphe 1, soit à une date, antérieure à celle-ci, de mise en oeuvre dans l'État membre concerné, un accord applicable à l'ensemble des travailleurs, prévoyant une information et une consultation transnationale des travailleurs, ne sont pas soumises aux obligations découlant de la présente directive.
