In its annual reports on monitoring the application of Community law, the Commission has regularly acknowledged the vital role played by the complainant in detecting infringements of Community law, compliance with which it ensures on the basis of, inter alia, the infringement procedure laid down by Article 226 of the Treaty establishing the European Community and Article 141 of the Treaty establishing the European Atomic Energy Community.

The Community institutions and the Member States acknowledge the importance of effective protection for the Community's financial interests. In order to combat fraud and other illegal activities affecting those interests, the Member States signed the Convention of 26 July 1995 on the protection of the European Communities' financial interests and several additional protocols which provide for measures aimed in particular at aligning national criminal laws. As these instruments have still not been ratified by all the Member States, the Commission has presented a proposal for a Directive on the basis of new Article 280 of the EC Treaty introduced by the Amsterdam Treaty, which incorporates a large proportion of their provisions.
Pour mieux lutter contre la fraude et les autres activités illégales portant atteinte aux intérêts financiers de l’Union européenne (UE), les États membres ont signé la Convention relative à la protection des intérêts financiers des Communautés, du 26 juillet 1995, ainsi que plusieurs protocoles additionnels. Ces instruments visent à harmoniser les législations pénales nationales en matière de protection des intérêts financiers de l’UE mais les délais de transposition par les États membres ont incité la Commission à présenter une proposition de directive qui reprend une grande partie de ces dispositions.
