In line with the Council Conclusions of 5 December 2011 as endorsed by the European Council of 9 December 2011 on the conditions for opening accession negotiations with Serbia, the Council recalls that the Commission is invited to present a report as soon as it will have assessed that Serbia has achieved the necessary degree of compliance with the membership criteria, notably the key priority of taking steps towards a visible and sustainable improvement of relations with Kosovo, in line with the Stabilisation and Association process, notably by fully respecting the principles of inclusive regional cooperation, fully respecting the provisions of the Energy Community Treaty; finding solutions for telecommunications; by continuing to implement in good faith all agreements reached; and by cooperating actively with EULEX, including with the Special Investigative Task Force.

Having regard to Article 87(3)(c) of the Treaty, aid should not have the sole effect of continuously or periodically reducing the operating costs which the beneficiary would normally have to bear, and should be proportionate to the handicaps that have to be overcome in order to secure the socio-economic benefits deemed to be in the Community interest.

The signatories of the Energy Community Treaty have today welcomed its coming into force on 1 July this year, at the Ministerial meeting of the Energy Community held in Luxembourg.

Although health issues have featured in the Treaties since the beginnings of the construction of Europe, it is only since the ratification of the Treaty of Maastricht that the Community has been able to implement a genuine public health strategy: five specific action programmes (cancer, AIDS, drug dependence, health promotion and health monitoring) have been adopted and three others proposed (rare diseases, injuries, pollution-related diseases) alongside other initiatives (reports on the state of health in the European Community, recommendations on the safety of blood products, etc.).

In this context, a clear framework of trade rules has to be established, and the prompt implementation of the Energy Community Treaty and the EU-Russia energy dialogue have a useful role to play, also with a view to ratification of the Energy Charter Treaty by the Russian Federation.
