IN-CONTEXT TRANSLATIONS

Since the objective of this Regulation; i.e. the establishment of a framework for European Research Infrastructures between Member States, cannot be sufficiently achieved by the Member States in the framework of their national constitutional systems, by reason of the trans-national nature of the problem, and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

Firmly believes that the legal uncertainty and high costs currently prevailing in the field of IPR contribute to the fragmentation of research efforts in Europe; therefore urges the Commission to proceed to an impact assessment of the different legal instruments that can be used to reduce existing barriers to knowledge transfer within the ERA; Or. PL notes that properly registered inventions can be an important source of knowledge and that legislation on IPR protection, including EU patent law, cannot be a barrier to knowledge-sharing; highlights the vital importance of establishing a Community Patent and a high-quality, cost-effective, innovation-friendly judicial system for European patents which respects the competence of the Court of Justice of the European Communities; notes the Communication from the Commission to the European Parliament and the Council on enhancing the patent system in Europe (COM(2007)0165); notes that the resulting legal framework will provide better incentives for private business involvement in research and will strengthen the position of EU innovators at international level;

And there are procedural reasons for this, because I believe, in agreement with the Committee on Legal Affairs and the Internal Market, that within the framework of the internal market and since there is freedom of establishment, Community funds cannot be used to finance research which is not permitted in some Member States.

The objectives of this Directive, namely the introduction of a special admission procedure and the adoption of conditions of entry and residence applicable to third-country nationals for stays of more than three months in the Member States for the purposes of conducting a research project under a hosting agreement with a research organisation, cannot be sufficiently achieved by the Member States, especially as regards ensuring mobility between Member States, and can therefore be better achieved by the Community. The Community is therefore entitled to take measures in accordance with the subsidiarity principle laid down in Article 5 of the Treaty.

They involve common implementation arrangements, and the necessary critical mass, to assure efficient and flexible conduct of research which is essential to the fundamental objectives of Community research and which covers a wide range of needs that cannot be satisfied within the thematic priorities.
Elles nécessitent des modalités de mise en oeuvre commune, et une masse critique, pour conduire de manière efficace et souple des travaux qui sont essentiels à la réalisation des objectifs fondamentaux de la recherche communautaire et qui couvrent des besoins de nature très variée qui ne peuvent être satisfaits dans le cadre des priorités thématiques.

In this light, the funding of research activities on surplus embryos with Community money cannot be justified in any way.

To this end, and in accordance with the objectives of the Commission Communication "Innovation in a knowledge-driven economy", activities will be implemented in a number of specific areas that are complementary and mutually supportive, within themselves and with the actions carried out under the heading "Integrating and strengthening the European Research Area". They will focus on improving the knowledge, understanding and capabilities of the actors involved - research workers, industrialists, investors, public authorities at European, national and regional levels, and others - by encouraging more intensive and fruitful interactions between them, and by providing strategic information and services, as well developing new methodologies and tools, to assist them in their particular endeavours. A general principle underlying all these actions is that innovation cannot be separated from research; the actions serve to reinforce the links between research and innovation, from the point of the conception of research activities, right through the period of their realisation.
À cet effet, et conformément aux objectifs de la communication de la Commission "L'innovation dans une économie fondée sur la connaissance", des actions seront mises en oeuvre dans certains domaines précis. Ces actions se compléteront et se renforceront à la fois entre elles et avec les actions menées sous la rubrique "Intégrer et renforcer l'espace européen de la recherche". Elles s'attacheront à améliorer les connaissances, la compréhension et les capacités des acteurs concernés - chercheurs, industriels, investisseurs, pouvoirs publics européens, nationaux et régionaux, etc. - en les encourageant à intensifier et à exploiter leurs interactions, en mettant à leur disposition des informations et des services stratégiques et en développant de nouvelles méthodologies et de nouveaux outils pour les aider à réaliser leurs objectifs respectifs. Toutes ces actions obéissent à un même principe général: l'innovation ne peut être dissociée de la recherche. Elles ont pour vocation de renforcer les liens entre la recherche et l'innovation dès les premiers stades des activités de recherche et pendant toute la durée de leur réalisation.

These activities will assure efficient and flexible conduct of research essential for the fundamental objectives of the Community, by underpinning the formulation and implementation of Community policies and by exploring new and emerging scientific problems and opportunities, where these requirements cannot be satisfied under the thematic priorities.
Ces activités assureront une conduite efficace et souple de la recherche, ce qui est essentiel pour atteindre les objectifs fondamentaux de la Communauté, en facilitant la formulation et la mise en oeuvre des politiques communautaires et en étudiant les problèmes et opportunités scientifiques nouveaux et émergents, lorsque ces exigences ne pourront être satisfaites dans le cadre des priorités thématiques.
