2. On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.
2. La Commission peut accorder au titulaire d'un brevet national ou communautaire ou au titulaire d'un droit d'obtention végétale qui ne peut pas exploiter son brevet (second brevet) ou son droit d'obtention végétale national ou communautaire sans porter atteinte à un brevet communautaire (premier brevet), sur demande, une licence obligatoire sur le premier brevet, à condition que l'invention ou l'obtention végétale revendiquée dans le second brevet ou le droit d'obtention végétale suppose un progrès technique important, d'un intérêt économique considérable, par rapport à l'invention revendiquée dans le premier brevet.

The positive points of the proposal include: (a) the introduction of a new definition for marketing which covers all entrepreneurial activities involving the marketing of propagating material and fruit plants, (b) the extension of the definition of 'supplier' to include the importer, (c) the implementation of certification in accordance with international systems of certification and identification of varieties based on the protocols of the Community Plant Variety Office and the guidelines for the protection of New Varieties of Plant and (d) an examination of plant health issues in accordance with the provisions of Directive 2000/29.
La proposition de directive du Conseil concernant la commercialisation des matériels de multiplication des plantes fruitières ainsi que la commercialisation des plantes fruitières apparaît indispensable si l'on veut pouvoir faire face aux évolutions constatées dans le secteur. Au nombre des points positifs de la proposition figurent a) l'introduction d'une nouvelle définition du terme "commercialisation", englobant toutes les activités liées à l'exploitation commerciale des matériels de multiplication et des plantes fruitières, b) l'ajout de l'importation à la liste des activités d'un "fournisseur", c) l'implication de la certification, conformément aux systèmes internationaux de certification et d'identification des variétés, sur la base des protocoles de l'Office communautaire des variétés végétales et des principes directeurs régissant la protection des nouvelles variétés végétales, et d) l'examen des questions relatives à l'état sanitaire des plantes, conformément à la directive 200/29/CE.

(17) That objective can best be achieved either through common knowledge of the variety, in particular for old varieties, or through the availability of a description based on Community Plant Variety Office (CPVO) protocols or in their absence on other international or national rules.

- As of now, ENP partner participation is not possible in some Community agencies restricted to supporting EC Member States in applying certain internal Community policies, such as, for instance, the European Centre for the Development of Vocational Training (Cedefop), the Office for Harmonisation in the Internal Market (OHIM), or the Community Plant Variety Office (CPVO).

[18] The Office of Harmonisation in the Internal Market (Alicante) and the Community Plant Variety Office (Angers) take individual decisions on the grant of European trademarks and plant variety rights.

Paragraph 4 of that Article lays down that, where a licence for a plant variety can be granted only by the Community Plant Variety Office, Article 29 of Regulation (EC) No 2100/94 shall apply.
