(4) Community patent law applicable to the Community patent should not replace the laws of the Member States on patents, nor European patent law as established by the Munich Convention. It would not in fact appear to be justified to require undertakings to apply for registration of their patents as Community patents, since national patents and European patents continue to be necessary for those undertakings which do not want protection of their inventions at Community level. This Regulation should therefore be without prejudice to the right of the Member States to grant national patents.

2. On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.

La Commission peut accorder au titulaire d'un brevet national ou communautaire ou au titulaire d'un droit d'obtention végétale qui ne peut pas exploiter son brevet (second brevet) ou son droit d'obtention végétale national ou communautaire sans porter atteinte à un brevet communautaire (premier brevet), sur demande, une licence obligatoire sur le premier brevet, à condition que l'invention ou l'obtention végétale revendiquée dans le second brevet ou le droit d'obtention végétale suppose un progrès technique important, d'un intérêt économique considérable, par rapport à l'invention revendiquée dans le premier brevet.

Chapter I on the Community Patent Court contains two major elements. Articles 1 to 3 of the Decision contain provisions which set up the Community Patent Court, determine the EC Treaty provisions to be applied to the Community Patent Court and provide a legal basis for an annex to the Protocol on the Statute of the Court of Justice containing the Statute provisions as applied by the Community Patent Court. Article 4 contains the special provisions relating to the Community Patent Court which are to be annexed to the Protocol on the Statute of the Court of Justice (hereinafter "Statute").

In the wake of the Lisbon European Council, the Commission put forward on 1 August 2000 a proposal for a Council regulation on the Community patent [COM(2000) 412 final] containing the relevant provisions applying to Community patents, in particular the provisions for the creation of a unitary Community patent title including the rights conferred by it, the possible actions for the enforcement of these rights, the grounds for invalidity as well as the mechanisms for the administration of granted Community patents such as their yearly renewal.
Au lendemain du Conseil européen de Lisbonne, la Commission a déposé, le 1er août 2000, une proposition de règlement du Conseil sur le brevet communautaire [COM(2000) 412 final] contenant les dispositions pertinentes pour la mise en oeuvre du brevet communautaire, notamment celles instituant un titre unitaire de brevet communautaire ainsi que les droits conférés par celui-ci, les voies de recours possibles pour faire valoir ces droits en justice, les causes de nullité ainsi que les mécanismes pour l'administration des brevets communautaires déjà délivrés, notamment pour leur maintien en vigueur.

The Community Patent Convention intending to create a unitary Community patent title was signed on 15 December 1975 in Luxembourg followed by the 15 December 1989 agreement relating to the Community patent including a protocol on the settlement of litigation concerning the infringement and validity of Community patents.
La Convention sur le brevet communautaire, visant à créer un titre de brevet unitaire à l'échelle de la Communauté, a été signée le 15 décembre 1975 à Luxembourg, et a été suivie, le 15 décembre 1989, par l'accord en matière de brevets communautaires comportant, entre autres, un protocole sur le règlement des litiges en matière de contrefaçon et de validité des brevets communautaires.

(2) The Munich Convention on the Grant of European Patents of 5 October 1973 (hereinafter referred to as the "Munich Convention") established the European Patent Office (hereinafter referred to as "the Office") and entrusted it with the task of granting European patents. The expertise offered by the Office should be used in the granting and administration of the Community patent. The national patent authorities may be enabled to carry out some of the work of dealing with Community patent cases, including the investigation of novelty, for the European Patent Organisation, provided that the national patent authorities meet quality standards agreed in advance. The granting of Community patents remains the sole responsibility of the European Patent Organisation.
(2) La convention de Munich sur la délivrance de brevets européens du 5 octobre 1973 (ci-après dénommée la "convention de Munich") a institué l'Office européen des brevets (ci-après dénommé l''Office", chargé de la délivrance de brevets européens. Il convient donc de recourir à l'expertise offerte par l'Office pour ce qui concerne la délivrance et l'administration du brevet communautaire. Les offices nationaux des brevets ont la possibilité d'assurer une partie des travaux de procédure liés au brevet communautaire pour le compte de l'Organisation européenne des brevets, notamment sous la forme d'enquêtes sur les innovations, à condition qu'ils respectent les normes de qualité qui ont été convenues au préalable. La responsabilité de la délivrance du brevet communautaire incombe uniquement à l'Organisation européenne des brevets.

(2) The Munich Convention on the Grant of European Patents of 5 October 1973 (hereinafter referred to as the "Munich Convention") established the European Patent Office (hereinafter referred to as "the Office") and entrusted it with the task of granting European patents. The expertise offered by the Office should be used in the granting and administration of the Community patent.

(7) For reasons of legal certainty , all actions relating to certain aspects of the Community Patent should come under the jurisdiction of one court, and the decisions of that court should be enforceable throughout the Community. Exclusive jurisdiction for a certain category of actions and applications relating to a Community patent, and in particular for actions relating to infringement and validity, should therefore be given to the Community intellectual property court.
(7) Des considérations de sécurité juridique requièrent que toutes les actions concernant certains aspects du brevet communautaire soient soumises à une même juridiction et que les décisions de cette juridiction puissent être exécutées dans toute la Communauté; en conséquence, il convient de donner compétence exclusive pour une catégorie d'actions et demandes concernant un brevet communautaire, et notamment concernant les actions relatives à la contrefaçon et la validité, au tribunal communautaire de propriété intellectuelle.

6. Considers that the Community patent system should coexist with national patent systems. The Community patent should also be converted into a European patent during the stage preceding the conclusion thereof. A system must likewise be devised which will ensure that European patents are converted into Community patents;
