Establishments or plants whose operations have already been approved in accordance with Community legislation on food hygiene should not be required to be approved or registered under this Regulation, as approvals or registrations under that Community legislation already take into account the objectives of this Regulation.

7. Manufacturers who consider or have reason to believe that a toy which they have placed on the market is not in conformity with the applicable Community legislation shall take the necessary corrective measures to bring that toy into conformity or withdraw it from the market and recall it from end users, if appropriate. They shall immediately inform the national authorities of the Member States where they made the toy available to this effect, giving details, in particular, of the non-compliance and of the corrective measures taken.
7. (i)there is corresponding Community legislation, in particular related to waste, and if requirements that are at least as stringent as those laid down in the Community legislation have been introduced in national legislation transposing such Community legislation,

As regards the Honourable Member’s question on whether the Commission intends to propose new legislation or amend existing legislation, while the Commission is not ruling out this possibility in the future, it would first have to be established that there are loopholes or a lack of clarity in the Community legislation or that additional Community legislation is the most appropriate response. Currently, we have no evidence that the problems can be attributed to shortcomings of the legislation.

1. The Centre shall be open to the participation of countries, which have concluded agreements with the Community by virtue of which they have adopted and apply legislation of equivalent effect to Community legislation in the field covered by this Regulation.

The main fields in which there have been failures to comply with the legislation either because it has not been transposed into national law or because the provisions of the Community legislation were not being complied with are the following: solid waste (three Member States were found by the Court of Justice in 2002 not to have introduced plans for waste management in accordance with the legislation on solid waste), water pollution by nitrates from agriculture (several adverse judgements from the Court of Justice), the treatment of urban waste water, water quality and, finally, compliance with the procedure for environmental impact assessments for various public and private projects.

2. The reduction in the number of types of committee and greater transparency in the functioning thereof should also enable members of the general public to understand and to have access to Community legislation. The Commission should inform Parliament more effectively and more regularly about the work of the committees, which will help to cultivate the habit of providing information and will reflect greater transparency. Regular publication of the committees' proceedings and the availability of information regarding the composition thereof, the agendas for their meetings and the decisions they take will help to make good the transparency deficit which all the Community institutions agree exists.
