Since the entry into force of the Community legal framework for an ERIC in 2009, two European research infrastructures have been awarded ERIC status.

Council Regulation (EC) No 723/2009 on the Community legal framework for a European Research Infrastructure Consortium[1] (hereinafter referred to as “the ERIC Regulation”) was adopted in order to facilitate the establishment and the operation of large European research infrastructures among several Member States and associated countries by providing a new legal instrument, the European Research Infrastructure Consortium (ERIC).
Le règlement (CE) n° 723/2009 du Conseil relatif à un cadre juridique communautaire applicable à un Consortium pour une infrastructure européenne de recherche[1] (ci-après le «règlement ERIC») a été adopté afin de faciliter la mise en place et l’exploitation de grandes infrastructures européennes de recherche parmi plusieurs États membres et pays associés par la conception d’un nouvel instrument juridique, le Consortium pour une infrastructure européenne de recherche (ERIC).

[4] Besides this Communication, the Commission adopted this year:- A Recommendation "on the management of intellectual property in knowledge transfer activities and Code of Practice for universities and other public research organisations", COM(2008)1329 of 10.4.2008; - A Communication "Better careers and more mobility: a European partnership for researchers", COM(2008)317 of 23.5.2008; - In addition, it is preparing a Council Regulation on a "Community legal framework for a European Research Infrastructure (ERI)" and a Communication on "A strategic European framework for international science and technology cooperation".
[4] Outre la présente communication, la Commission a adopté cette année:- une recommandation concernant la gestion de la propriété intellectuelle dans les activités de transfert de connaissances et un code de bonne pratique destiné aux universités et aux autres organismes de recherche publics [recommandation 2008/416/CE du 10 avril 2008, JO L146 du 5.6.2008, p.19, notifiée sous le numéro C(2008) 1329]; - une communication intitulée: «Favoriser les carrières et la mobilité : un partenariat européen pour les chercheurs», COM(2008)317 du 23.5.2008; - En outre, elle prépare actuellement un règlement du Conseil relatif à un cadre juridique communautaire applicable aux infrastructures européennes de recherche (IER) et une communication concernant un cadre stratégique européen pour la coopération scientifique et technologique internationale .

(40) Since the objective of the proposed action, namely to create a Community legal framework covering institutions for occupational retirement provision, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale and effects of the action, be better achieved by the Community, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
(40) Étant donné que l'objectif de l'action envisagée, à savoir la création d'un cadre légal communautaire couvrant les institutions de retraite professionnelle, ne peut pas être réalisé de manière suffisante par les États membres et peut donc, en raison des dimensions et des effets de l'action envisagée, être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures conformément au principe de subsidiarité consacré à l'article 5 du traité.
