In certain areas of the application of Community law where legal disputes are numerous, such as the environmental sphere, it should be possible to have more effective recourse to national courts, hence the need for the Commission to take legislative initiatives to facilitate such recourse.

A provision along the following lines has been suggested: "The fact that the parties have chosen the law of a non-member country shall not prejudice the application of the mandatory rules of Community law where all the other elements relevant to the situation at the time when the contract is signed are connected with one or more Member States".

4. Where all other elements relevant to the situation at the time of the choice are located in one or more Member States, the parties' choice of applicable law other than that of a Member State shall not prejudice the application of provisions of Community law, where appropriate as implemented in the Member State of the forum, which cannot be derogated from by agreement.

Under Community law, where any prior authorisation procedure is concerned there is no obligation to have a standstill period, and this regulation therefore does not apply.
