Benita Ferrero-Waldner, Member of the Commission (DE) Mr President, ladies and gentlemen, I think it is most important that we should remind ourselves that the Commission really is, in this respect, the guardian of Community law and that it regards the two European anti-discrimination directives as the fundamental instrument in the fight against inequality.

The comprehensive framework provided by the EU's two anti-discrimination Directives[1] has shaped the landscape of European anti-discrimination law for over a decade now.
Le cadre général aménagé par les deux directives européennes de lutte contre les discriminations[1] façonne le paysage législatif de l’UE dans ce domaine depuis plus d’une décennie.

38. Recognises that some progress has been made with regard to the protection of human and minority rights, including linguistic rights; points out, however, that in many candidate countries, abuse and discrimination persist due to shortcomings in the judicial and law enforcement systems and reiterates that the EU anti-discrimination acquis, in particular that regarding gays and lesbians, must be implemented as defined in Article 13 of the EC Treaty and in accordance with the Charter of Fundamental Rights of the European Union; furthermore, calls for a special effort to be made to combat and end human rights abuses of disabled persons living in institutions in candidate countries and calls for the dismantling of the institutionalisation approach in favour of integrated and community-based support measures for disabled people;

2. Takes the view that the exercise of the European citizen's right to petition Parliament and the Ombudsman constitutes an instrument with which to exercise control after the event over the application of Community law to specific cases, making it possible to condemn cases of failure to apply Community law, in particular violations of the principle of non-discrimination;
2. considère que l'exercice du droit accordé au citoyen européen de s'adresser au Parlement et au Médiateur constitue un instrument ultérieur en vue d'un contrôle a posteriori de l'application du droit communautaire aux cas concrets permettant de dénoncer les cas de manquements au droit communautaire, notamment les violations du principe de non-discrimination;

The measures put forward in the Action Plan will be implemented in respect of fundamental rights and obligations, in particular the right to privacy, in accordance with the relevant provisions of Community law, especially Regulation 45/2001 of the European Parliament and the Council of 18 December 2000 concerning the protection of individuals with regard to the processing of personal data by Community institutions and bodies and the free movement of such data.

With regard to the issue of a conflict between the rulings of the Court in Strasbourg and rulings in Luxembourg, it is worth noting that today, under Community law, the Court of Justice of the European Communities always refers to the European Convention on Human Rights, to actual decisions by the European Court of Human Rights, as the source of inspiration for decisions by the Court of Justice of the European Communities on fundamental rights issues.

In this context concerted use of available Community policy instruments should be made (e.g. the anti-discrimination and social inclusion measures introduced under Articles 13 and 137 of the Amsterdam Treaty, the employment strategy, the European Social Fund and other Community initiatives such as EQUAL and URBAN).

In November 2000, the Commission issued two important policy documents [11] on the one hand on a common asylum procedure and a uniform status for persons granted asylum and on another hand on a Community Immigration policy, where it is recalled that policies in that field must contain strong components of anti-racism, anti-xenophobia and anti-discrimination legislation and actions.
