IN-CONTEXT TRANSLATIONS

In order to enhance the capacity of the Community, the Member States and consequently the business community to prevent, to address and to respond to major network and information security risks, the European Network and Information Security Agency (ENISA) was established in 2004 for a period of five years.[3] The Agency was established with the main goal of “ensuring a high and effective level of network and information security within the Community, (..) in order to develop a culture of network and information security for the benefit of the citizens, consumers, enterprises and public sector organisations of the European Union, thus contributing to the smooth functioning of the internal market”.
Afin d'améliorer la capacité de la Communauté, des États membres et, de ce fait, du secteur des entreprises, pour prévenir, gérer et faire face aux principaux risques de sécurité des réseaux et de l'information, l'agence européenne chargée de la sécurité des réseaux et de l'information (ENISA) a été crée en 2004 pour une période de cinq ans[3]. L'agence a été établie avec l'objectif principal de " contribuer à un niveau élevé de sécurité des réseaux et de l'information dans la Communauté, (..) de favoriser l'émergence d'une culture de la sécurité des réseaux et de l'information, dans l'intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l'Union européenne, prenant part ainsi au bon fonctionnement du marché intérieur ".

The Agency should contribute towards raising the awareness of individual users of electronic communications, infrastructure and services, including by assisting Member States, where they have chosen to use the public interest information platform provided for in Directive 2002/22/EC of the European Parliament and of the Council of 7 March 2002 on universal service and users’ rights relating to electronic communications networks and services (Universal Service Directive) , to produce relevant public interest information regarding network and information security, and also by assisting in the development of such information to be included with the supply of new devices intended for use on public communications networks.
L’Agence devrait contribuer à sensibiliser les utilisateurs individuels des communications, infrastructures et services électroniques, y compris en aidant les États membres, lorsqu’ils ont choisi d’utiliser la plate-forme d’informations d’intérêt public prévue dans la directive 2002/22/CE du Parlement européen et du Conseil du 7 mars 2002 concernant le service universel et les droits des utilisateurs au regard des réseaux et services de communications électroniques (directive «service universel») , à produire des informations utiles d’intérêt public concernant la sécurité des réseaux et de l’information, et en aidant également à élaborer ces informations, qui doivent être jointes lors de la fourniture de nouveaux appareils destinés à être utilisés sur des réseaux publics de communications.

The Agency is also entrusted with enhancing cooperation between those involved in the area of network and information security, providing assistance to the Commission and the Member States in their dialogue with industry to address security-related problems in hardware and software products and contributing to Community efforts to cooperate with third States and, where appropriate, with international organisations to promote a common global approach to network and information security issues, thereby contributing to the development of a culture of network and information security.[10]
L'agence s'est également vu confier le renforcement de la coopération entre les parties impliquées dans le secteur de la sécurité des réseaux et de l'information, fournissant son assistance à la Commission et aux Etats Membres dans leur dialogue avec l'industrie pour aborder des problèmes relatifs à la sécurité dans les produits et logiciels et pour contribuer aux efforts de coopération de la Communauté avec les Etats tiers et, lorsque cela est approprié, avec les organisations internationales pour promouvoir une approche globale commune sur les questions de sécurité des réseaux et de l'information, contribuant ainsi au développement d'une culture de sécurité des réseaux et de l'information[10].

Where minimum information is not available via the single information point, the possibility of undertakings providing or authorised to provide public communications networks to directly request such specific information from any network operator in the area concerned should nevertheless be ensured.

Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services (Framework Directive) (7) requires that providers of public electronic communications networks or publicly available electronic communications services take appropriate measures to safeguard the integrity and security thereof, and introduces an obligation for the national regulatory authorities, where appropriate, to inform, inter alia, the Agency about any security breach or integrity loss that has had a significant impact on the operation of networks or services and to submit to the Commission and to the Agency an annual summary report on the notifications received and the action taken.
La directive 2002/21/CE du Parlement européen et du Conseil du 7 mars 2002 relative à un cadre réglementaire commun pour les réseaux et services de communications électroniques (directive «cadre») (7) exige que les fournisseurs de réseaux publics de communications électroniques ou de services de communications électroniques accessibles au public prennent les mesures appropriées pour assurer leur intégrité et sécurité et impose aux autorités réglementaires nationales, le cas échéant, d’informer entre autres l’Agence de toute atteinte à la sécurité ou perte d’intégrité ayant eu un impact significatif sur le fonctionnement des réseaux ou services, ainsi que de soumettre à la Commission et à l’Agence un rapport annuel succinct sur les notifications reçues et l’action engagée.

(18) Information society services span a wide range of economic activities which take place on-line; these activities can, in particular, consist of selling goods on-line; activities such as the delivery of goods as such or the provision of services off-line are not covered; information society services are not solely restricted to services giving rise to on-line contracting but also, in so far as they represent an economic activity, extend to services which are not remunerated by those who receive them, such as those offering on-line information or commercial communications, or those providing tools allowing for search, access and retrieval of data; information society services also include services consisting of the transmission of information via a communication network, in providing access to a communication network or in hosting information provided by a recipient of the service; television broadcasting within the meaning of Directive EEC/89/552 and radio broadcasting are not information society services because they are not provided at individual request; by contrast, services which are transmitted point to point, such as video-on-demand or the provision of commercial communications by electronic mail are information society services; the use of electronic mail or equivalent individual communications for instance by natural persons acting outside their trade, business or profession including their use for the conclusion of contracts between such persons is not an information society service; the contractual relationship between an employee and his employer is not an information society service; activities which by their very nature cannot be carried out at a distance and by electronic means, such as the statutory auditing of company accounts or medical advice requiring the physical examination of a patient are not information society services.
