The first appropriations allocated to cooperation in the fields of justice and home affairs, and asylum and immigration in particular, were entered in the Community budget before the Treaty of Amsterdam came into force.

On 5 October 2006 the Court upheld the Commission's position when it ruled that certain Member States were wrong to refuse to pay certain categories of resources into the Community budget, in this case instalments of traditional own resources recovered under a payment plan (Belgium)[14] and guaranteed and uncontested duties resulting from undischarged transit operations conducted in the form of Community transit (Belgium)[15] or under a TIR carnet (Germany[16] and Belgium).[17] On the same day the Court rejected a case brought against the Netherlands in connection with the burden of proof, but agreed that Member States must report infringements or irregularities as soon as they are aware of them and thus before expiry of the time limits (Article 11(1) of the TIR Convention); this applies mutatis mutandis to payment demands (Article 11(2) of the TIR Convention).

On the basis of the estimate, the Commission shall enter in the preliminary draft general budget of the European Union, which it shall place before the budgetary authority, in accordance with Article 272 of the Treaty establishing the European Community, the estimates it deems necessary for the establishment plan and the amount of the subsidy to be charged to that budget.

During a transitional period before the management authority takes up its responsibilities, the Commission shall be responsible for the operational management of Central SIS II. In accordance with the Financial Regulation applicable to the general budget of the European Communities, the Commission may delegate the operational management and tasks relating to implementation of the budget to national public-sector bodies in two different countries that meet the specific criteria outlined in Article 15, paragraph 4 of the SIS II Regulation.
