In accordance with Article 5 of Protocol No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, Denmark does not participate in the elaboration and the implementation of decisions and actions of the Union which have defence implications. IN-CONTEXT TRANSLATIONS

1. The provisions of the Dublin II Regulation which is annexed to this Agreement and forms part thereof, together with its implementing measures adopted pursuant to Article 27(2) of the Dublin II Regulation and — in respect of implementing measures adopted after the entry into force of this Agreement — implemented by Denmark as referred to in Article 4 of this Agreement, shall under international law apply to the relations between the Community and Denmark.

1. The aim of this Agreement is to apply the provisions of Council Regulation (EC) No 343/2003 of 18 February 2003 on the criteria and mechanisms for establishing the Member State responsible for examining a request for asylum lodged in Denmark or any other Member State of the European Union (Dublin II Regulation), Council Regulation (EC) No 2725/2000 of 11 December 2000 concerning the establishment of Eurodac for the comparison of fingerprints for the effective application of the Dublin Convention (Eurodac Regulation) and their implementing measures to the relation between the Community and Denmark, in accordance with Article 2(1) and 2(2).

Le présent accord vise à appliquer les dispositions du règlement (CE) no 343/2003 du Conseil, du 18 février 2003, établissant les critères et mécanismes de détermination de l’État membre responsable de l’examen d’une demande d’asile présentée au Danemark ou dans tout autre État membre de l’Union européenne («règlement Dublin II»), du règlement (CE) no 2725/2000 du Conseil, du 11 décembre 2000, concernant la création du système «Eurodac» pour la comparaison des empreintes digitales aux fins de l’application efficace de la convention de Dublin («règlement Eurodac») et de leurs mesures d’application aux rapports entre la Communauté et le Danemark conformément à l’article 2, paragraphes 1 et 2.

(a) in matters of jurisdiction, where the defendant is domiciled in Denmark, or where Article 22 or 23 of the Regulation, applicable to the relations between the Community and Denmark by virtue of Article 2 of this Agreement, confer jurisdiction on the courts of Denmark.
