Parliament takes the view that an exclusivity clause ensuring good practice on board Community vessels and an EU commitment to ensuring the sustainability of resources in non-Community waters, while guarding against unfair competition among Community operators, should be included in fisheries agreements and not just in protocols.

I believe that the Fisheries Agreement with the Seychelles demonstrates clearly that the objectives of this Community policy are in very good health, despite the criticisms from some quarters, and that this kind of protocol is still essential in order to maintain competitiveness and employment for the Community sector, while it is increasingly involved in the promotion of more responsible fisheries systems outside of Community seas.

In the meantime, in order to lift a significant barrier to innovation, the Member States and Commission should together make the existing patent system more efficient by the ratification of the London Protocol and through progress on the European Patent Litigation Agreement, while ensuring their compatibility with Community law.

While agreeing to the reproduction of the text of Article 9(2)(a) of the Second ACP-EEC Convention in Article 5(2)(a) of Annex V, the Community reaffirms the interpretation of that text, namely that the ACP States shall grant to the Community treatment no less favourable than that which they grant to developed States under trade agreements where those States do not grant the ACP States greater preferences than those granted by the Community.
