Pursuant to Article 3 of Council Regulation (EC) No 768/2005 of 26 April 2005 establishing a Community Fisheries Control Agency and amending Regulation (EEC) No 2847/93 establishing a control system applicable to the common fisheries policy (2) the missions of the Community Fisheries Control Agency (CFCA) are, inter alia, to coordinate the operations to combat illegal, unreported and unregulated fishing in conformity with rules of the European Union.
Aux termes de l’article 3 du règlement (CE) no 768/2005 du Conseil du 26 avril 2005 instituant une agence communautaire de contrôle des pêches et modifiant le règlement (CEE) no 2847/93 instituant un régime de contrôle applicable à la politique commune de la pêche (2), les missions de l’Agence communautaire de contrôle des pêches (ACCP) consistent, entre autres, à coordonner les opérations visant à lutter contre la pêche illégale, non déclarée et non réglementée, conformément aux règles de l’Union européenne.

Specific control and inspection programmes shall be implemented by the Member States concerned on the basis of joint deployment plans established under Council Regulation (EC) No 768/2005 of 26 April 2005 establishing a Community Fisheries Control Agency and amending Regulation (EC) No 2847/93 establishing a control system applicable to the common fisheries policy (14).
Les programmes spécifiques de contrôle et d’inspection sont mis en œuvre par les États membres concernés sur la base de plans de déploiement commun établis conformément au règlement (CE) no 768/2005 du Conseil du 26 avril 2005 instituant une agence communautaire de contrôle des pêches et modifiant le règlement (CEE) no 2847/93 instituant un régime de contrôle applicable à la politique commune de la pêche (14).

To this end, it is appropriate within the Community’s existing institutional structure, and taking account of the repartition of competences between the Commission and the Member States, to establish a Community Fisheries Control Agency (‘the Agency’).

This Regulation establishes a Community Fisheries Control Agency (‘the Agency’), the objective of which is to organise operational coordination of fisheries control and inspection activities by the Member States and to assist them to cooperate so as to comply with the rules of the Common Fisheries Policy in order to ensure its effective and uniform application.

Also included among Community shipowners are "nationals of a Member State established outside the Community or shipping companies established outside the Community and controlled by nationals of a Member State, if their ships are registered in and fly the flag of a Member State in accordance with its legislation" (Article 2(2)(c)). The Commission considers that the concept of "control by nationals of a Member State" referred to in that Article means that the majority of the company's capital is held by Community nationals.
