I am pleased to note that the opinions of the European Parliament are similar to those of the Commission with regard to the measures to be taken to improve the fight against VAT fraud within the European Union. I am particularly happy about the widespread support for the main objective of the Commission’s first concrete proposal, namely to accelerate, by January 2010, the gathering and exchange of information concerning intra-community transactions.
Je note avec satisfaction que les avis du Parlement européen et de la Commission se rejoignent quant aux mesures à prendre pour améliorer la lutte contre la fraude à la TVA dans l’Union européenne; je me réjouis tout particulièrement du soutien général exprimé en faveur de l’objectif principal de la première proposition concrète de la Commission, à savoir accélérer, d’ici à janvier 2010, la collecte et l’échange d’informations au sujet des opérations intracommunautaires.

(19) Since the objectives of the proposed action, namely the participation and cooperation of national regulatory authorities at Community level, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of effects of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. In accordance with the principle of proportionality, as set out in that Article, this Regulation does not go beyond what is necessary in order to achieve those objectives.

(17) Since the objective of the proposed action, namely better foreseeability of court judgments requiring genuinely uniform rules on the law applicable to contractual obligations determined by a mandatory and directly applicable Community legal instrument, cannot be adequately attained by the Member States, who cannot lay down uniform Community rules, and can therefore, by reason of its effects throughout the Community, be better achieved at Community level, the Community can take measures, in accordance with the subsidiarity principle set out in Article 5 of the Treaty. In accordance with the proportionality principle set out in that Article, a Regulation, which increases certainty in the law without requiring harmonisation of the substantive rules of domestic law, does not go beyond what is necessary to attain that objective.
(17) Etant donné que l'objectif de l'action envisagée, à savoir l’adoption de règles uniformes sur la loi applicable aux obligations contractuelles afin d’assurer une meilleure prévisibilité des décisions de justice en la matière , ne peut pas être réalisé de manière suffisante par les Etats membres et peut donc en raison des effets de l’action mieux être réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité. (14 ) The objectives of the proposed action, namely drugs prevention and information, cannot be sufficiently achieved by the Member States because of the need for an exchange of information at EU level and for the Community-wide dissemination of good practices. This can be better achieved at Community level. Due to the need for a coordinated and multidisciplinary approach and by reason of the scale and impact of the initiative, the Community may adopt measures, in accordance with the principle of subsidiarity, as set out in Article 5 of the Treaty.

One possibility is that a name can only be protected if it is connected with the Community name ‘gts’ and the corresponding Community symbol, in which case it is possible to find other products on the market which have the same name as the registered product, but which are manufactured using a different process and consequently are not entitled to use the Community name and the Community symbol.
