WHEREAS an Association known as the Canadian Red Cross Society has been in operation for some years past, and was actively engaged during the late war in South Africa in contributing funds and tending the sick and wounded; and whereas the said association was in affiliation with the Society in England known as " The National Society for Aid to the Sick and Wounded in War" , and the work, operations and powers of the last named Society have now been transferred to and are being carried on, under the patronage of His Majesty King Edward the Seventh, by the British Red Cross Society, with which the Canadian Red Cross Society has now become affiliated; and whereas the International Conference of Geneva of 1863 recommended: " That there should exist in every country a Committee whose mission consists in co-operating in times of war with the hospital service of the armies by all means in its power" ; and whereas it is expedient that there should be a permanent organization in Canada in affiliation with the British Red Cross Society to carry out the purposes of the said treaty, and especially to secure supplies and to execute the humane objects contemplated by the said treaty, with the power to adopt and use the distinctive flag and badge specified by the said treaty in Article 7, on which shall be the sign of the Red Cross, and for the purpose of co-operating with the " Comité International de Secours aux Militaires Blessés" ; and whereas it is expedient that the existing association in Canada should be incorporated for the purposes aforesaid: Therefore His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:—

F. whereas legislative negotiations on many files have shown divergent interpretations among the institutions on certain issues; whereas, in accordance with Rule 37a of its Rules of Procedure, Parliament's committees may request an opinion from the Committee on Legal Affairs when scrutinising a proposal which provides for delegated acts; whereas the Conference of Presidents on 13 January 2012 endorsed a common line, and on 19 April 2012 endorsed a horizontal approach to be followed by individual committees in order to overcome differences of opinion; whereas that common line needs to be taken one step further by Parliament setting out its own criteria for the application of Articles 290 and 291 TFEU and by endeavouring to agree on such criteria with the Council and the Commission;
F. considérant que les négociations législatives concernant de nombreux dossiers ont indiqué que certaines questions sont source d'interprétations divergentes entre les institutions; considérant que, conformément à l'article 37 bis du règlement, les commissions du Parlement peuvent solliciter l'avis de la commission des affaires juridiques lors de l'examen d'une proposition contenant des actes délégués; considérant que la Conférence des présidents a approuvé, le 13 janvier 2012, une ligne commune et, le 19 avril 2012, une approche horizontale que les commissions se doivent de suivre afin de surmonter les divergences d'opinions; considérant que le Parlement doit aller plus loin que cette ligne commune en fixant ses propres critères pour l'application des articles 290 et 291 du traité FUE et en tentant d'obtenir un accord sur ces critères avec le Conseil et la Commission;

Having regard the facts that the recast version of the Parent-Subsidiary Directive was adopted in September 2011 and the Common Consolidated Corporate Tax Base Report was adopted this year by the ECON Committee; and taking into account the facts that there are recent estimates indicating that tax evasion and tax avoidance, which cost the governments of the European Union a significant amount of uncollected revenues; whereas the loss of revenues raises the deficit and debt levels of the different Member States; whereas the cooperation between the tax systems of the different Members States would be more and more desirable, it is needed to amend the Directive in order to further tighten the possibility of unintended non-taxation, double taxation or tax-avoidance fraud among the Member States causing more damages to the well functioning of the internal market as stated in the recently adopted Motion for a resolution on 'all for concrete ways to combat tax fraud and tax evasion'.

Mrs. Karen Kraft Sloan: With all due respect to Mr. Herron, and I understand what he's attempting to do with his motion, I believe it may be somewhat contradictory and may be deemed inadmissible, because he is suggesting that the review should be undertaken by Parliament every five years, and then it's referring to the House of Commons committees, whereas the motion L-6 in your name, Mr. Chair, is consistent in the requirement for the parliamentary committees to undertake this review.

As you know, a press release was issued yesterday and the government said that it would essentially adopt a process similar to that employed for Mr. Justice Rothstein's appointment, with the exception that the Parliament committee that will screen the pool of applicants and bring it to three persons will be composed exclusively of House of Commons members, whereas last time, if my memory is correct, there were also representatives from the bar and from the judiciary.
