This Regulation introduces a common approach to ensuring that users of public mobile communications networks, when travelling within the Union, do not pay excessive prices for Union-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.

With a view to preserving the guidance that may be drawn from past judgments of the European courts and Commission decisions pursuant to Regulation (EEC) No 4064/89, while at the same time maintaining consistency with the standards of competitive harm which have been applied by the Commission and the Community courts regarding the compatibility of a concentration with the common market, this Regulation should accordingly establish the principle that a concentration with a Community dimension which would significantly impede effective competition, in the common market or in a substantial part thereof, in particular as a result of the creation or strengthening of a dominant position, is to be declared incompatible with the common market.
Afin de préserver les enseignements pouvant être tirés des précédents arrêts prononcés par les juridictions européennes et des décisions prises par la Commission en vertu du règlement (CE) n° 4064/89, tout en sauvegardant en même temps la cohérence avec les critères de détermination du préjudice concurrentiel appliqués par la Commission et les juridictions communautaires pour statuer sur la compatibilité d'une concentration avec le marché commun, le présent règlement devrait en conséquence établir le principe selon lequel les concentrations de dimension communautaire qui entraveraient de manière significative une concurrence effective, notamment du fait de la création ou du renforcement d'une position dominante, dans le marché commun ou une partie substantielle de celui-ci doivent être déclarées incompatibles avec le marché commun.

(4) This problem must be solved by revising the common market organisation for rice, in such a way as to take control of output, improve the equilibrium and fluidity of the market and enhance the competitiveness of Community agriculture, while pursuing the other aims of Article 33 of the Treaty, including maintaining suitable income support for producers.

11. Invites the Commission to negotiate a multilateral agreement on steel industry in order to eliminate public subsidies and tariff and non-tariff barriers to establish a full liberalisation of steel trade on the world market, while respecting environmental and social norms. It should maybe be appropriate for the Commission to continue the discussions with the American authorities to make sure that the anti-dumping measures do not exceed the present WTO rules, and later on to present a common EU-US position with the aim of concluding a multilateral agreement on steel;
