(3) Where, in respect of a control period, the Commodity Board of a province assigns a federal quota to a person in that province who previously had not been assigned a federal quota or increases a federal quota, the Commodity Board shall do so in such a manner that the number of pounds of turkey produced in that province and authorized by the Commodity Board to be marketed in interprovincial and export trade or in intraprovincial trade during that control period and the number of pounds of turkey produced in the province and anticipated to be marketed during the same control period other than as authorized by the Commodity Board do not exceed the number of pounds of turkey set out in the schedule for that province.

(2) The Commodity Board of a province shall assign federal quotas to producers in that province in respect of a control period in such a manner that the number of pounds of turkey produced in that province and authorized by the Commodity Board to be marketed in interprovincial and export trade or in intraprovincial trade during that control period and the number of pounds of turkey produced in the province and anticipated to be marketed during the same control period other than as authorized by the Commodity Board do not exceed the number of pounds of turkey set out in the schedule for that province.

(2) The Agency, in establishing a quota system, shall assign quotas in such manner that the number of pounds of turkey meat produced in a province and authorized to be marketed in interprovincial and export trade in the year 1973, when taken together with the number of pounds of turkey meat produced in the province and authorized to be marketed in intraprovincial trade in the same year, pursuant to quotas assigned by the appropriate Board or Commodity Board, and the number of pounds of turkey meat produced in the province and anticipated to be marketed in the same year, other than as authorized by a quota assigned by the Agency or by the appropriate Board or Commodity Board, will equal the number of pounds of turkey meat set out in section 3 of this Plan for the province.

Moreover, since SOCTA of 2013 points out the prevalent importance of sea and air ports as entry points for criminal organisations for trafficking in human beings and illegal commodities, specific vulnerabilities represented by crime routes at these external crossings should be reflected in the distribution of available resources for actions undertaken by Member States through criteria relating to the number of passengers and weight of cargo processed through international air and seaports.

The exemptions in Directive 2004/39/EC that relate to dealing on own account or to dealing or providing other investment services in relation to commodity derivatives covered by Sections C(5), C(6) and C(7) of Annex I to that Directive or derivatives covered by Section C(10) of that Annex I could be expected to exclude significant numbers of commercial producers and consumers of energy and other commodities, including energy suppliers, commodity merchants and their subsidiaries from the scope of that Directive, and therefore such participants will not be required to apply the tests in this Regulation to determine if the contracts they deal in are financial instruments.
