Notes that these developments have led to concerns regarding the principles of the rule of law, democracy and fundamental rights in Hungary over the past years, which, taken together, could represent an emerging systemic threat to the rule of law in this Member State; is of the opinion, contrary to the statement made by the Commission before Parliament on 2 December 2015, that the conditions for the activation of the rule of law framework and Article 7(1) are fully met; believes that Hungary presents a test for the EU to prove its capacity and willingness to react to threats to and breaches of its own founding values by a Member State; notes with concern that developments in some other Member States show worrying signs of an undermining of the rule of law similar to that in Hungary; regrets that the Commission’s continued lack of political willingness to address properly the situation in Hungary is creating a precedent with regard to other Member States that are adopting similar worrying trends concerning respect for the rule of law; believes that this raises serious concerns as to the ability of the Union to ensure continuing respect for the political Copenhagen criteria once a Member State has acceded to the Union;
6. relève que ces événements ont suscité des inquiétudes au sujet des principes de l'état de droit, de la démocratie et des droits fondamentaux en Hongrie au cours des dernières années, qui, au total, pourraient constituer l'émergence d'une menace systémique pour l'état de droit dans cet État membre; estime que, contrairement à la déclaration faite par la Commission devant le Parlement le 2 décembre 2015, les conditions pour l'activation du cadre de l'état de droit et pour l'application de l'article 7, paragraphe 1, sont pleinement réunies; estime que la Hongrie permet de tester la capacité et la volonté de l'Union de réagir aux menaces et aux violations de ses propres valeurs fondamentales par un État membre; note avec inquiétude que certaines évolutions dans d'autres États membres montrent des tendances similaires au non-respect de l'état de droit observé en Hongrie; déplore que le manque de volonté politique persistant de la Commission à remédier comme il se doit à la situation en Hongrie crée un précédent pour d'autres États membres qui affichent de telles tendances préoccupantes en matière de respect de l'état de droit; estime que cela soulève de sérieuses questions quant à la capacité de l'Union d'assurer le respect continu des critères politiques de Copenhague après l'adhésion d'un État membre à l'Union;

Takes note of the opinion of the Venice Commission (No CDL-AD(2011)016) which 'welcomes the fact that this new Constitution establishes a constitutional order based on democracy, the rule of law and the protection of fundamental rights as underlying principles'; further takes note of the opinion of the Venice Commission (No CDL-AD(2012)001) according to which the adoption of a large amount of legislation in a very short time frame could explain why some of the new provisions do not comply with European standards; further takes note of the opinion of the Venice Commission on the Fourth Amendment to the Hungarian Fundamental Law (No CDL-AD(2013)012) stating that 'the Fourth Amendment itself brings about or perpetuates shortcomings in the constitutional system of Hungary';
10. prend acte de l'avis de la commission de Venise (n° CDL-AD (2011)016), qui "se félicite du fait que la nouvelle Constitution mette en place un nouvel ordre constitutionnel fondé sur les principes essentiels de la démocratie, de l'État de droit et de la protection des droits fondamentaux"; note en outre l'avis de la commission de Venise (n° CDL-AD(2012)001), selon lequel l'adoption de nombreux textes de loi dans un laps de temps très court pourrait expliquer pourquoi certaines des nouvelles dispositions ne satisfont pas aux normes européennes; note également l'avis de la commission de Venise sur le quatrième amendement à la Loi fondamentale (N° CDL-AD(2013)012) selon lequel le quatrième amendement lui-même introduit ou perpétue des insuffisance dans le régime constitutionnel de la Hongrie;
