On the basis of the same judgments, therefore, the todays letter, supplementing the letter of 1991, informs the Member States that in appropriate cases the Commission may - after giving the Member State concerned the opportunity to comment and to alternatively consider the granting of rescue aid, as defined by the Community guidelines - adopt a provisional decision ordering the Member State to recover any funds which have been disbursed in infringement of the procedural requirements.
