The Council notes the Commission's proposed set of actions, in particular (i) the setting up of a Commercial Communications Expert Group made up of representatives of the Commission and the Member States and (ii) the proposal to apply a transparent assessment methodology to future Commission decisions concerning cross-border commercial communications services.

For example, the Commission has already begun work in the area of commercial communications and has examined in detail with Member States representatives in its Expert Group the possibilities of applying the principle of mutual recognition to the national rules in the sub-area of sales promotions [40].

As a first step, the Commission started collecting information on various technical and statistical aspects of passive gear, leading to two expert reports.2 The communication which the Commission has now adopted contains a condensed version of the technical conclusions of these experts, together with an examination of commercial and social aspects (there are indications, for example, that some fishing techniques using passive gear would yield a better unit price and secure more jobs than the currently widespread use of trawls).
