By way of derogation from Article 54(5), the risk-sharing instrument shall be used to finance operations co-financed by the ERDF or the Cohesion Fund, regarding investment costs which cannot be financed, as eligible expenditure pursuant to Article 55, or pursuant to the Union rules on State aids.

Such risk sharing instrument shall be used exclusively for loans and guarantees, as well as other financial facilities, to finance operations co-financed by the European Regional Development Fund or the Cohesion Fund, regarding expenditure which is not covered by Article 56.

As regards the publication of beneficiaries of the Structural Funds and the Cohesion Fund, this obligation is further specified by Commission Regulation (EC) N° 1828/2006. Its Article 7 (1) (d) requires the publication of three categories of information: a) the list of the beneficiaries, b) the names of the operations and c) the amount of the public funding allocated to the operations.
En ce qui concerne la publication des noms des bénéficiaires des Fonds structurels et du Fonds de cohésion, cette obligation est détaillée dans le règlement (CE) n° 1828/2006 de la Commission, qui prévoit, à l'article 7, alinéa 1, point d), la publication de trois types d'informations: a) la liste des bénéficiaires, b) le nom des opérations et c) le montant du financement public alloué aux opérations.

(52a) Transitional provisions should be added. First, in Article 181(1), as regards the making available again of decommitted appropriations corresponding to commitments made during the 2000-2006 Structural Funds programming period, the case of force majeure should continue to be applied as provided in the Financial Regulation of 25 June 2002 until the closure of the assistance. This is in order to avoid disruption of the current system since force majeure is treated differently in the new Regulation governing the Structural Funds. Second, in Article 181(2), to deal with the implementation of the provisions on the central database for exclusion from participation in procurement and grant procedures. Finally, in Article 181(3) to deal with the outstanding Community commitments to be financially settled in order to close the assistance provided for in the Regulations governing the Structural Funds and the Cohesion Fund for the 2000-2006 programming period.
(52 bis ) Il y a lieu d'ajouter des dispositions transitoires, premièrement, à l'article 181, paragraphe 1, en ce qui concerne la reconstitution de crédits dégagés correspondants aux engagements inscrits durant la période de programmation 2000-2006 des Fonds structurels, où le cas de force majeure devrait continuer à s'appliquer tel que prévu dans le règlement financier du 25 juin 2002 jusqu'à la clôture de l'intervention, et ce afin d'éviter de perturber le système actuel étant donné que les cas de force majeure sont traités différemment dans le nouveau règlement régissant les Fonds structurels; deuxièmement, à l'article 181, paragraphe 2, pour régler la mise en œuvre des dispositions relatives à la base de données centrale destinée à exclure certaines personnes des procédures de marchés publics et de subventions; enfin, à l'article 181, paragraphe 3, pour régler les engagements communautaires restants qui doivent faire l'objet d'une liquidation financière afin de clôturer l'intervention prévue dans les règlements régissant les Fonds structurels et le Fonds de cohésion pour la période de programmation 2000-2006.
