Bill S-7 has four objectives: to amend the Criminal Code to authorize investigative hearings and recognizance with conditions; to amend the Canada Evidence Act to allow a judge to order the public disclosure of potentially sensitive information concerning a trial or an accused, once the appeal period has expired; to amend the Criminal Code to create new offences for a person who leaves or attempts to leave Canada for the purpose of committing an act of terrorism; and lastly, to amend the Security of Information Act to increase the maximum penalties for harbouring any person who has committed, or is likely to commit, an act of terrorism.

First, it amends the Criminal Code in order to provide for investigative hearings and to allow for the imposition of a recognizance with conditions—the so-called preventive arrest; second, it amends the Canada Evidence Act to allow judges to order the public disclosure of potentially sensitive information about a trial or an accused once the appeal period has expired; third, it amends the Criminal Code to create new offences of leaving or attempting to leave Canada to commit a terrorist act; and fourth, it amends the Security of Information Act to increase the maximum penalty for harbouring a person who has committed or is likely to commit a terrorist act.

The main components of the bill, as Senator Wallace has pointed out, are interesting: unlawfully possessing government-issued identification documents that contain information of another person, and then the accompanying Criminal Code amendments creating a new offence of fraudulently redirecting or causing redirection of a person's mail; and, secondly, creating a new offence of possessing a counterfeit Canada Post mail key — and on it goes.

Is concerned, however, by the Turkish Supreme Court’s interpretation of the Code of Criminal Procedure extending the pre-trial detention period to 10 years in clear violation of European standards in this respect; calls on the Turkish Grand National Assembly to amend the relevant law in accordance with the case law of the European Court of Human Rights; also draws attention to Turkey’s obligation to comply strictly with its commitment under Article 6 ECHR on a fair trial within reasonable time, notably by creating courts of appeal in its legal system and reinforcing the capacity of its supreme courts;

On 12 November 2010 the Lithuanian Parliament voted to proceed with the examination of an amendment to the Administrative Code establishing a new offence punishable by a fine for the ‘public promotion of homosexual relations’ and seeking to implement the ‘Law on the Protection of Minors Against the Detrimental Effect of Public Information’ adopted on 14 July 2009, which bans – despite having been vetoed twice by Lithuanian Presidents, criticised by the European Parliament, and condemned by NGOs defending human rights and LGBT organisations – ‘information that would promote sexual relations or other conceptions of concluding a marriage or creating a family other than established in the Constitution or the Civil Code’.
