The Civil Service Tribunal moreover considered — in paragraph 38 of the judgment under appeal — that the fact that, in rejecting the complaint, the AECE, while upholding the decision not to renew the applicant’s contract, thus departed from the statement of reasons contained in the decision of 15 October 2010 and instead adopted other reasons, cannot, of itself, render the non-renewal decision illegal, since the whole point of the complaint procedure is to allow review by the AECE of the contested decision in the light of the grievances put forward by the complainant, where appropriate modifying the reasons serving to support its operative part.
Le Tribunal de la fonction publique a, par ailleurs, considéré – au point 38 de l’arrêt attaqué – que la circonstance que, dans le rejet de la réclamation, l’AHCC, tout en maintenant la décision de ne pas renouveler le contrat de la requérante, se soit ainsi écartée de la motivation contenue dans la décision du 15 octobre 2010 pour retenir d’autres motifs ne saurait, en elle-même, rendre la décision de non-renouvellement illégale, l’objectif de la procédure de réclamation étant précisément de permettre le réexamen par l’AHCC de l’acte attaqué au regard des griefs avancés par le réclamant, le cas échéant en modifiant les motifs servant de support à son dispositif.

If the General Court sets aside a decision of the Civil Service Tribunal but considers that the state of the proceedings does not permit a decision, it shall refer the case to a chamber other than that which ruled on the appeal.

(1) It is necessary, in accordance with the second paragraph of Article 62c of Protocol No 3 on the Statute of the Court of Justice of the European Union ('the Statute') and Article 2(2) of Annex I thereto, to lay down the rules governing the appointment of temporary Judges to the European Union Civil Service Tribunal ('the Civil Service Tribunal'), their rights and duties, the conditions under which they may perform their duties and the circumstances in which they would cease to perform those duties.

The Commission states that although the Rules of Procedure of the Civil Service Tribunal, unlike those of the General Court, do not provide for the adoption of a measure of inquiry ordering the parties to the dispute to produce documents, Article 24 of the Statute of the Court of Justice, which is applicable to the Civil Service Tribunal, would have permitted the adoption of such a measure since that provision permits, inter alia, the Courts of the European Union to require the parties to produce all documents and to supply all information which they consider desirable.

Moreover, the Commission adds that Article 44(2) of the Rules of Procedure of the Civil Service Tribunal contains a provision which would have permitted, in the present case, the adoption of an order addressing its concerns arising from the sensitive nature of the documents requested.
